@johank76 @Deathtongue_71 Undantagen i GDPR innebär att din artikel torde vara förenlig med GDPR, men enl EPL krävs etikprövning oavsett om GDPR art 9 st 2 gäller. En annan absurd följd är att domar som ligger öppet tillgängliga på HD:s hemsida inte får användas i forskning utan föregående etikprövning.

@johank76 @Deathtongue_71 Det kan man tycka, men så är det nog tyvärr inte. GDPR har förvisso företräde före svensk lag, men det gäller bara när de reglerar samma sak. Här har de olika tillämpningsområden, så du måste följa både GDPR och EPL.

Kan man skriva politisk filosofi om nu levande filosofer utan etikprövning? För några år sedan publicerade jag en artikel om Habermas teori om den normativa relationen mellan demokrati och mänskliga rättigheter. 1/n cambridge.org/core/journals/…

At long last I’m pleased to announce that my final conclusions from my research project on national courts and preliminary references are forthcoming in next issue of European Law Review. Thanks to the editors, reviewers, and everybody who has commented over the years!

@fquintay Thanks! Repeat referrals is a really interesting issue that deserves to be examined more in depth (and that is not covered by my project)

@AnnaWallerman Ntnl CC can "dialogue" on the same issue in separate referrals, so that the "influence" of such dialogue is spread along a number of otherwise discrete cases; still, your research brings significant weight to the argument that the "dialogue" is mostly fictional: kudos!

@fquintay My method is more quantitative and shows no difference overall between supreme/constitutional and lower courts. But of course that does not exclude occasional examples to the contrary, which I agree one can find.

@AnnaWallerman I find your point very persuasive, the only possible limited exception being when the national Court is a Constitutional Court, since in some (admittedly, very few) cases the ECJ "fine tuned" its earlier reasoning in response to new referrals of CC.
