I have LEO copters circling the area all the time. They can look right into your living room from 1/4 mile away if they want. The drone in question here was not at "30 feet" or some other laughable assertion. It was most definitely at ~100' or more altitude, where you would be if you were looking for a bear and spotted some guys milling around the backyard with a weapon. Police don't fly first response drones around like a FPV hobbyist. And for all we know, this might have been a bigass Brinc first responder drone, not a Mavic Mini, at which point to decide to shoot at it would be summarily stupid.

You 'could' say that but it, in this particular case, wouldn't hold up. This case in no way represents any sort of practical application of Castle Doctrine or violation of expectation of privacy. No more than if a cop had been driving by and witnessed some guys with a weapon in a yard and stopped to check on the situation. And especially if a cop was responding to a report of a bear in the area and witnessed some men with an unknown weapon in a backyard in the area where the bear was reported. The cop could infer that the bear had been sighted there, or that the men might be shooting at the bear in a residential area. Does this make any sense to you at all or are you just looking for engagement?
