Today marks the anniversary of Gideon v. Wainwright, the Supreme Court decision that recognized that in criminal cases, the right to counsel is not a luxury, it is a constitutional necessity. That right is supposed to mean more than simply having a lawyer’s name on paper. It is supposed to mean meaningful representation, communication, preparation, advocacy, and a real defense. In Michael Allen’s case, serious concerns have been raised about whether that right was truly honored. Michael repeatedly told the court he was dissatisfied with his representation, stated that important communication and case access issues existed, and made clear that he felt forced to fight for his own life without the kind of defense the Constitution was meant to guarantee and was ultimately punished for that. The right to counsel is one of the foundations of a fair trial. When that right is weakened, ignored, or reduced to the bare minimum, justice is put at risk. Today, as we reflect on Gideon v. Wainwright, we are reminded that the right to counsel should mean effective representation, not just having a lawyer assigned to your case. It is with a heavy heart that I share that David "Lead Pipe" Hennessy has passed away. He has been an acquaintance of mine throughout my entire legal career. He was such a commanding figure in the courtroom. He will be so missed. And my heart just breaks for his wife. Who is the nicest person you will ever meet. Today marks 5 whole years since Kaivonni’s passing. This day carries weight. A child passed away, and that loss will always matter. While time has moved forward, for many, the questions have not. There are still things that do not make sense. There are still concerns about how this case was handled. There are still pieces that feel unresolved. Because of that, grief has never had the space to simply be grief. Michael has not been able to mourn his daughter privately or peacefully. Each year has been overshadowed by accusations, courtrooms, and an outcome he maintains does not reflect the full truth. This does not feel like justice.. Not for him and definitely not for Kaivonni. Today, her life is remembered. The loss is acknowledged. Though the pain is still there for all, the commitment to seeking truth remains.True justice should bring clarity, not lingering doubt. After Michael spoke up in court about his lack of defense, he didn’t get a strategy meeting. He got a letter from his attorney, Nicholas Podlaski, formally shutting down communication with Michael’s support system. They called the public advocacy “harassment.” But let’s be clear: Michael was in jail. He couldn’t email. The “harassment” was simply his family and the public asking why his attorney wasn’t doing his job. This created a lose-lose situation: If Michael stayed silent, he went to trial defenseless. If he spoke up, his attorney threatened to cut off communication. Michael Allen faced life in prison, and he was forced to fight the State and his own counsel at the same time. Judge Fran Gull, the Judge presiding over Michael’s case, announced today that she is retiring to “relax, spend time with family, and play with her grandchildren.” Must be nice. Michael Allen doesn’t get to relax. He doesn’t get to spend time with his family. He doesn’t get to play with his children. He doesn’t even get the chance to properly grieve the loss of his daughter, Kaivonni. She gets a pension and a peaceful exit. Michael gets a prison cell for a crime science shows he did not commit. Retirement does not wash away a legacy of wrongful convictions. You can leave the bench, but you cannot escape the truth. We are still here, and we are still fighting. I see a lot of celebration, and I understand why. But what also worries me is this: her daughter works in the prosecutor’s office. Maybe that means nothing. Maybe it does.
