Il y a du vrai et du faux dans ce post
1) l’administration fiscale à compter de 2026 aura en effet le pouvoir de vérifier notamment avec l’échange automatisé d’informations si vous avez un compte ouvert à l’étranger et par conséquent de vous redresser sur une période pouvant s’étendre à 10 ans sur vos wallets/app/comptes d’échangeurs centralisés non déclarés
Majoré à 1500€ / an = 15,000€ par compte maxi si vous l’aviez depuis 10 ans soit 2015-2016 y’a assez peu de chance mais dans la pratique c’est VRAI
2) NON une Ledger ou compte non custodial n’est PAS à déclarer à l’administration fiscale (en tout cas pour l’instant)
3) L’imposition ne se fera pas d’office sur ce que vous n’avez pas déclaré mais c’est en réalité encore plus sournois que ça : s’ils arrivent à justifier du côté du fisc que vous avez délibérément soustrait vos obligations déclaratives, ils qualifieront ça d’activité occulte et là non seulement vous allez manger du 80/90% de pénalité mais aussi accrochez vous bien c’est là où ça devient marrant ils vont prendre au barème progressif la plus haute somme que vous possédiez sur ce portefeuille d’échangeur à la date donnée
Exemple : vous n’aviez pas déclaré votre Binance ouvert en 2020, vous avez fait 100k€ de profit en 2021, que vous les ayez cashout ou non, ou même perdu entre temps sur FTX en 2022, l’administration fiscale peut dans le pire des cas vous mettre :
Barème progressif sur 100k€ donc on doit être de tête a quelque chose comme ~40% soit 40,000€
Amende record de +90% donc vous rajoutez 36,000€ soit total 76,000€
Wallet non déclaré pendant 5 ans soit 5x1500=7 500€
Total total = 83,500€ pour 100,000€ non déclarés
Y’en a qui vont commencer à transpirer 🥲
