Hong Kong's Court of Final Appeal today upheld a law that makes it a crime to publicly call on people to cast blank ballots or boycott elections. Among the five judges who voted to uphold the law was William Gummow, a former justice of Australia's highest court, who has sat as a non-permanent overseas judge on the CFA since 2013. Today he lent his name, and the standing of the High Court of Australia, to criminalizing a basic act of political expression. The reasoning is, of course, thin. The court called the restriction "necessary" because calls to cast blank ballots risk "undermining the legitimacy" of Hong Kong's elections, a legitimacy the government has done the most to erode by barring opposition candidates from running. It drew a line between abstaining and backing a candidate, holding that only abstention threatens the system, while declining to mention that openly supporting pro-democracy candidates can itself land you in prison. The foreign judges on the CFA have drawn little public attention since the resignations a few years ago in response to a global campaign led by @thecfhk. Today is a reminder of what their presence still buys Beijing: a veneer of common law respectability over rulings that hollow out the rights those judges were meant to protect. The CCP uses these stations as part of its transnational repression operations, to suppress criticism even overseas. They are also running a campaign against the women with SafeGuard Defenders that did this research. Using fake porn etc. to harass her.

Another excellent sign times are changing and the gross naivety towards Beijing is becoming a thing of the past.👏 More work to be done countering PRC in Europe but this is a flat-out rejection of Beijing's assertion it's ie supposedly a sovereign "civilization without borders".

❗️BREAKING: sentences handed down in 🇨🇳 interference (HKETO) case: Bill Yuen 8 years and Peter Wai 10 years in jail (Wai’s sentence includes misconduct in public office). Almost in tears with relief, on behalf of so many who live under threat of intimidation from Beijing. This is a landmark moment for the UK. For years, dissidents and experts have warned that Beijing’s interference operations are running amok in Britain. Today, the courts have drawn a hard line: run hostile intelligence operations against people on British soil, you’re not going home to a heroic welcome, you're going to a UK prison cell. The Chinese have a saying 不作不死 (no doing, no dying). In crude English: FAFO. Beyond happy that this is the future Beijing’s proxies can look forward to if they behave in this way, thanks to the National Security Act.

Freedom House is horrified by the killing of artist and cartoonist Semyon Skrepetsky (Robert Kuzovkov), whose work fearlessly mocked and challenged some of the world’s most repressive leaders. The Kremlin’s record speaks for itself. Critics have been imprisoned, exiled, poisoned, and killed. If this attack was connected to Skrepetsky’s activism and artistic work, it would be another reminder that authoritarian regimes often view themselves as judge, jury, and executioner when it comes to those who expose their corruption and abuse. Polish authorities should fully investigate this crime, including any potential transnational links, and hold those responsible accountable.
