Another fine morning to address members of the Mumu Men Association. Meet Ayuma from Butere,, born out of wedlock but later life upgraded her with a stepdad on a lifetime subscription. The man didn’t just step up, he took over completely. The mumu man was basically running a one-man NGO called Operation Raise Another Man’s Cumzigo. Fast forward to last week, wedding bells ringing. Daughter of Agrippina decided to tie the knot with the love of her life. Suddenly, madam remembers she has a biological father stored somewhere in the archives of history. Out of nowhere, she insists that ONLY the biological father will hand her over. That decision landed in the house like a hot siilap from Kidero. The stepdad who has been doing everything since Kapenguria six was just there, stunned, seeing with his mouth wide open. The mother also refused that script immediately. But daughter of Agrippina was determined like a politician during campaign season. She went out, traced the biological father, dusted him off, and assigned him the VIP role of the century pale mbele kwa meza ya wafalme. On the wedding day, the Stepdad refused to show up due to embarrassment. The Mother almost skipped too, trying to save her own marriage from going down the drain. Another reason to leave single mothers at their father's compounds. In fact, pass her like you have not seen anything. If you choose to step up, just know this life has no refund policy. So, there I was, minding my business and boarding Lopha Fleet 212. I decided to be a digital citizen and pay via M-Pesa. Through it all, I sat there, calculating what that 40 Bob could buy. Two Mandazi? A tropical sweet? My dignity? ​Then we reached TRM. ​Suddenly, the conductor developed a clinical case of Instant Selective Amnesia. Our previous agreement? Deleted from his system. My 40 Bob? Vanished into the Bermuda Triangle of his pockets. ​I contemplated starting a scene. I really did. Please hide and post for me! I'm so heartbroken, can you imagine. I was going through my husband of 15 years' phone yesterday and suddenly found myself on his WhatsApp. I was attracted by a message that popped up from him best friend david whom they've known each other longer than me. He sent a message saying "i can't get over what you did to me yesterday " . I thought my eyes were playing tricks on me then i quickly ran to their chat. I found many heartfelt messages and weird pictures of them together including this one. This one is a bit decent cause they're covered up. I saw pictures of them kîssing, doing everything lovers can do together. I couldn't hold myself, i confronted him. Instead he blamed me for going through his phone and beat me up thoroughly. I'm in hospital! As if it's not enough, he sent me a message asking for a divorce. Mind you we have 3 kids, a home we've built for the last 15 years. It doesn't stop there. He's a pastor at church! Should i try to talk to him back to his senses?

@NytoP2PMwangi Firstly, EADB acted in bad faith by failing to release balance of loan for development but iñstead paid for land directly to sellers only. Secondly, refusing a buyout by KCB is mischievous and I wonder why courts didn't see this as malice afterthought. I stand with Tuju.

I think many people are not fully understanding Raphael Tuju's case. Before I repost, here's a blow-by-blow account of the case as explained by a reputable lawyer! Here's a simple analogy that everyone can relate to: Imagine you sit down with your very rich uncle, who agrees to help you start an Uber business. The agreement is this: It's a loan. You raise 30% of the car's value yourself, then he pays the remaining 70%. After that, he will also help you cover insurance, vehicle inspection, driving license, and other required certifications so you can start operating. Your uncle buys the car and hands it over to you. But then he refuses to follow through on the rest of the agreement, he won't pay for the insurance, inspection, driving license, or other certifications. Now the car is sitting at home, unused and unable to earn money. As days pass, you technically default on the loan because you can't repay it without running the business. You then approach a rich friend who offers to buy the car outright and pay off your uncle in full. But your uncle refuses the offer. Instead, he sends auctioneers to repossess the car. You rush to court for help, but the court refuses to listen or assist you! ######################### Now Here is The Case! The case involving Raphael Tuju and the East African Development Bank (EADB) is a long-running debt dispute from a 2015 loan. It is not simply about failing to repay a loan. Tuju's company, Dari Limited, borrowed money from EADB to buy and develop prime properties in Karen, Nairobi. These include a 20-acre land called Entim Sidai (with plans for luxury bungalows) and a historic bungalow built by Scottish missionary Dr. Albert Patterson (now a high-end restaurant like Tamarind Karen and Dari Business Park). Blow by Blow accounts!!! 1. How the bank handled the money for buying the property The loan included funds to purchase the historic property from a Scottish family (linked to Dr. Albert Patterson's estate). Instead of giving the money directly to Tuju or his company, EADB paid the sellers directly. This is called direct disbursement. - In practice, this gave the bank strong control over the deal right away. The property became security (collateral) for the loan immediately after payment. - This is a standard banking practice in some secured loans to reduce risk, but it has been part of Tuju's arguments about the nature of the transaction. 2. The main loan problem and why the project stopped The loan agreement covered both buying the land and funding construction/development (reportedly around Ksh 297 million or more for parts of the project, like building high-end bungalows). - EADB provided funds for the land purchase but did not release the full amount needed for construction. - The project stalled because of this lack of development funds. Tuju's side argues this made it impossible for them to complete the work, generate income, and repay the loan, a situation sometimes called a "breach" by the lender under contract law (where one party prevents the other from fulfilling their side). - Courts (including in the UK and Kenya) have not accepted this as excusing the default, and ruled the debt must be repaid. 3. Attempt to pay off the loan early using another bank When the project failed and the loan went into default, Tuju tried to settle the full debt. He arranged for KCB Bank to step in and pay off EADB completely (a "buyout" or redemption). - EADB reportedly rejected this offer and did not provide a redemption statement (a document showing the exact amount owed to clear the loan). - This refusal has been raised as evidence of unwillingness to accept repayment, though courts have allowed the bank to proceed with recovery instead…1/2

@NytoP2PMwangi Banks don't operate like shylocks, when a loan is disbursed it becomes payable the following month and the first installment is expected unless you negotiate for a moratorium. Once the bank paid for the land, the first and subsequent installments became due.

There's more than meets the eye in this entire mess. The fact that all courts, local and foreign favour the bank is proof of this. From a layman's perspective, this is an open and shut case of sabotage by the bank, but the judicial system doesn't seem to agree. Why? It may be that there was a clear and blatant breach from Tuju's side since all this happened during Jubilee's tenure, when he was a CS. We all know how powerful politicians behave, thinking that they are above the law🤔
