Iran, he said, has had a religious fatwa against developing nuclear weapons since 2004. And the US had no intelligence indicating that fatwa was being violated or was about to be lifted. Therefore, no imminent threat. Therefore, the war was unjustified. Read that again. 𝗧𝗵𝗲 𝗺𝗮𝗻 𝘄𝗵𝗼 𝘄𝗮𝘀 𝗗𝗶𝗿𝗲𝗰𝘁𝗼𝗿 𝗼𝗳 𝘁𝗵𝗲 𝗡𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗖𝗼𝘂𝗻𝘁𝗲𝗿𝘁𝗲𝗿𝗿𝗼𝗿𝗶𝘀𝗺 𝗖𝗲𝗻𝘁𝗲𝗿 𝗶𝘀 𝘁𝗲𝗹𝗹𝗶𝗻𝗴 𝘂𝘀 𝘁𝗵𝗲𝗿𝗲 𝘄𝗮𝘀 𝗻𝗼 𝗻𝘂𝗰𝗹𝗲𝗮𝗿 𝘁𝗵𝗿𝗲𝗮𝘁 — 𝗯𝗲𝗰𝗮𝘂𝘀𝗲 𝗜𝗿𝗮𝗻 𝘀𝗮𝗶𝗱 𝘀𝗼. Let's examine what Kent's fatwa argument actually rests on. The fatwa was never written down. Not once. It exists only as oral statements made by Khamenei at various points going back to 2003 — statements the Atlantic Council, MEMRI, and multiple Iran analysts have documented were designed specifically to mislead international negotiators. Former Iranian President Rouhani himself admitted in a magazine interview that he cited the fatwa to strengthen Iran's position in nuclear negotiations. It was a diplomatic tool. It was never codified. It was never independently verifiable. MEMRI concluded flatly that 𝘁𝗵𝗲 𝗳𝗮𝘁𝘄𝗮 𝗯𝗮𝗻𝗻𝗶𝗻𝗴 𝗻𝘂𝗰𝗹𝗲𝗮𝗿 𝘄𝗲𝗮𝗽𝗼𝗻𝘀 𝗮𝘁𝘁𝗿𝗶𝗯𝘂𝘁𝗲𝗱 𝘁𝗼 𝗞𝗵𝗮𝗺𝗲𝗻𝗲𝗶 𝘀𝗶𝗺𝗽𝗹𝘆 𝗱𝗼𝗲𝘀 𝗻𝗼𝘁 𝗲𝘅𝗶𝘀𝘁 𝗮𝘀 𝗮 𝗳𝗼𝗿𝗺𝗮𝗹 𝗿𝗲𝗹𝗶𝗴𝗶𝗼𝘂𝘀 𝗱𝗲𝗰𝗿𝗲𝗲. But let's say you believe the fatwa was real. Here is what Kent conveniently skips. In February 2025 — a full year before Operation Epic Fury began — IRGC commanders were already actively pressuring Khamenei to rescind his nuclear weapons ban. In March 2025 — eleven months before the operation — Khamenei's own advisor Ali Larijani publicly stated Iran would have no choice but to develop nuclear weapons if attacked. Iran's atomic energy spokesman said building a nuclear bomb was now "the simplest move." A top Iranian nuclear scientist said that if ordered, he would build one. One Iranian parliamentarian stated that with Khamenei's permission, Iran was "a week away" from testing its first weapon. Meanwhile, as of the last IAEA inspection before the strikes, Iran held 440 kilograms of uranium enriched to 60% purity — the largest stockpile of highly enriched uranium held by any non-nuclear-weapon state in the history of the world. Enough, if further enriched to 90%, for approximately ten nuclear weapons. 𝗛𝗲𝗿𝗲 𝗶𝘀 𝗮 𝗳𝗮𝗰𝘁 𝗞𝗲𝗻𝘁 𝗮𝗽𝗽𝗮𝗿𝗲𝗻𝘁𝗹𝘆 𝗱𝗼𝗲𝘀 𝗻𝗼𝘁 𝗳𝗶𝗻𝗱 𝗿𝗲𝗹𝗲𝘃𝗮𝗻𝘁: civilian nuclear power reactors require uranium enriched to between 3.5% and 5%. Research reactors used for medical isotopes require around 20%. There is no accepted civilian application — none, zero — for uranium enriched to 60%. That enrichment level exists for one purpose. And here's the detail that should k!ll Kent's argument entirely: going from 60% to weapons-grade 90% is actually easier than getting to 60% in the first place. The hard technical work is already done. Iran's breakout time from that stockpile was measured in weeks, possibly days. And now the fatwa is legally d∗ad. In Shia jurisprudence, a fatwa is tied to the life of the marja who issues it. Khamenei was k!lled on February 28. Mojtaba Khamenei has never reaffirmed it. The one document Kent says stood between Iran and the bomb expired the moment Khamenei did. 𝗛𝗲𝗿𝗲'𝘀 𝗞𝗲𝗻𝘁'𝘀 𝗲𝗻𝘁𝗶𝗿𝗲 𝗶𝗻𝘁𝗲𝗹𝗹𝗶𝗴𝗲𝗻𝗰𝗲 𝗰𝗮𝘀𝗲: Iran told us they had a religious ruling against nukes. We believed them. We had no evidence they were cheating. Therefore no threat. CIA Director Ratcliffe testified under oath before the Senate Intelligence Committee that Iran's nuclear and missile programs were continuing at alarming rates and that degrading those capabilities was critical to US national security. The DNI, the Speaker, and the entire national security apparatus said the threat was real. Kent — who was cut from intelligence briefings months ago and had nothing to do with Iran war planning — went on Tucker's podcast and told us the mullahs' fatwa was good enough for him. 𝗧𝗵𝗶𝘀 𝗶𝘀 𝗻𝗼𝘁 𝗶𝗻𝘁𝗲𝗹𝗹𝗶𝗴𝗲𝗻𝗰𝗲 𝗮𝗻𝗮𝗹𝘆𝘀𝗶𝘀. 𝗜𝘁'𝘀 𝗿𝗲𝗮𝗱𝗶𝗻𝗴 𝗜𝗿𝗮𝗻𝗶𝗮𝗻 𝗿𝗲𝗴𝗶𝗺𝗲 𝗽𝗿𝗲𝘀𝘀 𝗿𝗲𝗹𝗲𝗮𝘀𝗲𝘀 𝗮𝗻𝗱 𝗰𝗮𝗹𝗹𝗶𝗻𝗴 𝗶𝘁 𝗮 𝗱𝗮𝘆. And setting aside entirely the leaking allegations — if this is what passes for analytical rigor at the National Counterterrorism Center, Kent should have been fired for sheer incompetence long before any of this became public.
