Kick Streamer Mizkif's lawsuit with OTK and Twitch Streamers Emiru and Asmongold on breach of contract and defamation was forwarded to a magistrate judge for recommendations. Today, the magistrate judge came back with her recommendations: she recommended that Asmongold's motion to dismiss be granted, that the statement Emiru made on stream constitutes defamation, assuming that the gist of the statements that Mizkif provided is fact, and that Emiru's motion to dismiss be denied. The judge also recommends that Emiru's motion for Mizkif to provide a definite statement be granted. If it's granted, it requires Mizkif and his lawyers to specifically point out exactly where on Emiru's livestream she was defamatory, rather than providing a "gist" of what she said. These recommendations are not final and are open to objections for the district judge to review.

"Defendants MTD fails to interact or engage with the FAC in any meaningful way." "There are effectively zero citations or specific references to the factual claims asserted in the FAC. This is likely out of necessity, because Defendant knows that as soon as the alleged statements or facts are acknowledged accurately the defamatory meanings become inescapable. Therefore, all Defendant can do in the MTD is produce generic, boilerplate arguments with no connection to the actual pleading."
