Karma is finally coming for Meta, through the legal system. As we await a verdict in Los Angeles on whether social media platforms were designed to addict young people, it's important to note that TWO courts have already ruled against Meta in the past month. 1) Yesterday, a jury in New Mexico established that Meta's platforms are not safe for kids, and that their design enabled the exploitation of children. This is a watershed moment: This is the FIRST time a jury has evaluated the evidence. The evidence was so compelling that the jury said Meta should pay $375 million dollars in civil penalties for the harms it has caused to New Mexico and its citizens. But it gets worse for Meta: a few weeks ago, in Delaware, a court ruled that Meta's insurance companies do not have a duty to defend Meta or cover its costs in the thousands of lawsuits playing out in California because, under California law, if a company caused harm through "intentional acts" rather than accidentally, the insurers have no obligation to defend that company. Because the documents brought out in the NM and LA trials show intentional actions, Meta loses insurance coverage. That's what the insurance companies asserted, and the judge agreed with them. Going forward, social media companies will be judged like any other company whose product design decisions harm children. These two rulings mark a profound shift toward accountability. Mississippi's brief repeatedly said ballots must be "submitted to election officials" by Election Day. But they also argued that handing a ballot to a common carrier — FedEx, the Postal Service — satisfies that requirement. Gorsuch's response: those two things don't add up. 𝘍𝘦𝘥𝘌𝘹 𝘪𝘴𝘯'𝘵 𝘢𝘯 𝘦𝘭𝘦𝘤𝘵𝘪𝘰𝘯 𝘰𝘧𝘧𝘪𝘤𝘪𝘢𝘭. Then he dropped the hypothetical that made everyone in that courtroom uncomfortable. Imagine a state where a large portion of voters mail their ballots on or near Election Day. The day after the election, a bombshell story breaks — a candidate's scandal, or evidence of collusion with a foreign power. The losing candidate urges voters to recall their ballots. FedEx will do it — you can call and cancel a delivery. And it swings the election. 𝗗𝗶𝗱 𝘁𝗵𝗲 𝗲𝗹𝗲𝗰𝘁𝗶𝗼𝗻 𝗵𝗮𝗽𝗽𝗲𝗻 𝗼𝗻 𝗘𝗹𝗲𝗰𝘁𝗶𝗼𝗻 𝗗𝗮𝘆? Mississippi's lawyer said yes. Gorsuch pushed: even though it changed the outcome? The lawyer had to admit: yes. Gorsuch's response: 𝘵𝘩𝘢𝘵 𝘩𝘢𝘴 𝘵𝘰 𝘣𝘦 𝘺𝘰𝘶𝘳 𝘢𝘯𝘴𝘸𝘦𝘳, 𝘥𝘰𝘦𝘴𝘯'𝘵 𝘪𝘵? When the lawyer insisted Mississippi law prohibits ballot recall, Gorsuch asked him to show where. The lawyer couldn't. Gorsuch had read the statute and the regulations himself — and the regulation says a ballot is final when "marked accepted." That doesn't prohibit recall. It actually permits it. This ruling is expected in June or July — right before the midterms. Tommy Tuberville (R-Auburn) called on Republican holdouts in the Senate Monday to end the filibuster so Congress can pass the SAVE America Act, a voting integrity bill that has been blocked by Senate Democrats. Appearing on Newsmax’s “Rob Schmitt Tonight,” Tuberville warned that failure to pass the bill would have lasting consequences for Republicans. “If we don’t pass this, we’ll never have another secure election in this country because we’ll never have any kind of majority again,” @SenTuberville said. “It’s just amazing to me how we’re letting this opportunity pass us by.” Tuberville said four or five Republican senators have refused to vote to end the filibuster, which currently requires 60 votes to advance legislation. Republicans hold 53 Senate seats, meaning they would need near-unanimous support to break the threshold.
