@iamintrospect I don't work for Apple and this is not legal advice, but OTA updates for bug fixes and UI changes have been pretty broadly adopted for a while now. I'd assume it's a bit of a grey area

Don't try to detect App Review
Keep your App Store metadata consistent with what users actually see
When in doubt, submit the variant you want to test for review
