Day 4 of Musk v. Altman trial in Oakland federal courthouse!
Elon Musk continues to get cross-examined by OpenAI’s lawyer William Savitt, who once represented Tesla (and Twitter in its battle against Elon Musk). Elon will then be cross-examined by Microsoft’s lawyer and then direct-examined by his own lawyer Steven Molo.

NYC observations after spending last week there • people are actually outside touching grass (or cement 😅) • very few AI ads or billboards around • even cafes i went to - very few screens with claude code or cursor or some coding tool • people are way more open to socializing. everyone is willing to strike up a conversation (not about AI agents) • the energy is electric - everyone’s moving with purpose. • found a way to talk to folks without mentioning AI • way more artists, and non traditional creators. Met an actual physical product designer which was cool. it’s genuinely refreshing to remember there’s a whole world outside the feed been traveling the last few days and the SF tech bubble makes it easy to forget how alive real cities feel. sorry SF, you’re still home… but perspective is healthy 🤷♂️

In opening statement yesterday, OpenAI's lawyer argued that Elon was suing OpenAI to give his own AI company xAI, which makes the chatbot Grok, an edge. Elon says "xAI has a very small market share" and that al though it is "technically a competitor," it is "much much smaller than OpenAI."

At various times, Elon says he, Sam Altman, Greg Brockman, and Ilya Sutskever brainstormed various ways to fund OpenAI, which was a nonprofit. They talked about attaching it to Tesla or creating a for-profit entity. “I was not opposed to there being a small for-profit that provides funding to the nonprofit,” he says, as long as the tail didn’t waive the dog.

“Nobody ever told Microsoft that it helped violate any special donation conditions" stipulated by Elon Musk, says Microsoft's lawyer. Musk is suing Microsoft for aiding and abetting OpenAI. He claims that Microsoft knew that its investment in OpenAI's for-profit ventures helped OpenAI breach its duty to donors, including Musk.

Because Larry does not care enough about AI safety, he thought, there should be a “counterbalance to Google”: “an open-source nonprofit would be the opposite of Google,” which is closed-source and for-profit, he says.

OpenAI's lawyer pulls up a photo of the founding members of OpenAI during the company's early days, wearing T-shirts and jeans in a scrappy office and “working day and night," he says. Musk, who was at Y Combinator, came by occasionally to “yell at people for not moving fast enough,” he says. “He used his funding commitment to bully the other members of the OpenAI founding team," he says.

None of the billionaire tax coverage about Sergey Brin in Bloomberg or the NYTimes reports the most important structural detail of why he opposes it so much more than Jensen. It taxes voting shares as ownership.
It taxes Page and Brin as if they own 50+% or >$2 trillion of Google rather than 3% each. Jensen does not have super voting shares so he is just taxed like his actual ownership of Nvidia.
Imagine if you were taxed like you earned 10 times as much as you actually did last year. @bizcarson @teddyschleifer
