The Court restrained the Defendants from publicly performing or communicating PPL’s sound recordings without obtaining a valid license from PPL. Any unauthorized use of PPL’s sound recordings during the matches would amount to infringement and may also lead to contempt of the Court’s order. The Court emphasised that the plaintiff’s rights in the sound recordings were prima facie demonstrated from the documents appended to the plaint. The Court observed that as the exclusive licensee, the plaintiff was entitled to grant licences for public performance and opined that the defendant’s actions on 19 October 2025 and 31 December 2025 amounted to violation of copyright. In Commercial IP Suit (L) No. 4398 of 2026, the Bombay High Court restrained the owner of The Coffee Next Door from communicating music from PPL’s repertoire at its premises. The Court observed that Defendant’s Section 60 suit would not bar the Court from granting ad interim relief. Importantly, the Court rejected the Defendant's contention that the event was a private gathering exempted under Section 52(1)(za) and went on to observe that the, the event was ticketed, and the religious exemption does not extend to such commercial events. The Court Prima Facie recognised PPL’s rights in its repertoire of sound recordings based on assignment deeds and exclusive agreements, and recorded that such documents are available on PPL’s website and appended to the plaint (in CD form). The Defendant has given a formal undertaking to the Court that: 1.If it plays or communicates any music/sound recordings at its premises, it will first obtain the requisite license from the copyright PPL. 2.If any third-party event organizer conducts an event at its premises, the Defendant will ensure that the organizer obtains the requisite license before playing any sound recordings. The Hon’ble Court specifically modified the undertaking to make it clear that merely imposing a condition is not enough — the venue must ensure compliance before permitting music to be played. This order reinforces the legal obligation of Event Venues, Hotels/Resorts, Grounds, Exhibition Centres & Banquet Halls under Section 51 (a) (ii) of the Copyright Act 1957. The matter clarifies an important legal position: A license from other copyright bodies/societies (e.g. IPRS for underlying works) does not substitute the requirement of a valid license for sound recording works from the rightful owner/authorized entity. The wide ambit of Section 52(1)(za) of the Copyright Act renders it vulnerable to misuse by persons seeking to cloak commercial performances under the garb of marriages or religious ceremonies. Read full article here:- barandbench.com/view-point/mar…
