#Drake Drake v. UMG Appeal: A Discussion Herein, I’ll discuss Drake’s appeal of the dismissal of civil case against UMG based on Kendrick Lamar’s song “Not Like Us.” This discussion will address my opinion about the case and the contents of the parties’ appellate briefs. Note: I am only addressing the defamation part and not the harassment and botting claims which I find to be nonsensical. Part 1. My Opinion about the case. I have long maintained that this lawsuit by Drake was a huge mistake and was unwise. The lawsuit compounded Drake’s mistakes during the diss battle with Kendrick Lamar. This appeal continues to compound Drake’s mistakes. During the diss battle, Drake got defensive (example, Drake said “if I was f***g underage girls I would’ve been in jail…”). Wrong move. In a diss battle you ALWAYS play offense rather than defense. If you’re steeped in the culture, you know that there’s no room for defense during “yo momma” jokes: it’s always offense. If someone said “yo momma so fat when she sat down the bus tipped over” you don’t respond by saying that “my momma ain’t fat, she weighs 110 LBs”. Drake also made the mistake of using AI voices of Tupac and Snoop. Another mistake by Drake was in trying to preemptively take the sting out of an expected attack. In my profession, you can bring out bad facts about your witness on direct exam so that it would not look as bad when the opposing cross examines the witness about those bad facts. That tactic doesn’t work in a diss battle. Telling Kendrick, “talk about him liking young girls…” predictably didn’t stop Kendrick from talking about that subject. In fact, it encouraged Kendrick.
