MALAVA ELECTION PETITION UPDATE: We went into the 28th November 2025 Malava by-election with our heads held high after running a peaceful, people-centred, and issue-based campaign that resonated deeply with the people of Malava. However, what followed remains one of the gravest assaults on democracy in recent times. The people’s victory was violently taken away through a coordinated scheme involving intimidation, violence, voter manipulation, abuse of State machinery, and the eventual imposition of a remote-controlled leadership against the clear sovereign will of the electorate. At the heart of the dispute was not only electoral malpractice, but also the fundamental question of constitutional eligibility and integrity. Serious concerns were raised regarding the eligibility of the declared winner to contest the election, yet those concerns were disregarded despite their profound constitutional implications. An election cannot be legitimised where questions of qualification and constitutional compliance remain unresolved. It is both tragic and ironic that the very police officers constitutionally mandated to protect citizens were accused of orchestrating violence and terrorising innocent voters. Kenya is slowly witnessing the dangerous normalization of goon culture within governance structures — a path that threatens to erode democratic institutions and public trust. Further allegations were raised regarding widespread bribery and misuse of public resources by State officers, including a proved claim that relief food intended for vulnerable citizens in Elgeyo-Marakwet was diverted and distributed in Malava during the election period to influence voters. There were also grave concerns over the alleged ejection of agents from polling stations, collusion between certain officials and electoral officers, and the falsification of statutory election forms. Despite the seriousness of these grievances and the compelling evidence presented before the court, judgment was still entered in favour of the declared winner — a decision many supporters view as deeply troubling and difficult to reconcile with the constitutional promise of free, fair, transparent, and credible elections. Nevertheless, we remain proud of the exceptional legal representation mounted by the Petitioners’ legal team led by Senior Counsel Nelson Havi, assisted by Edgar Busiega and others, whose industry, courage, and mastery of the law inspired many Kenyans who still believe in justice and constitutionalism. This struggle is far from over. We shall continue pursuing justice through every lawful avenue available, including the highest court of the land, because democracy, constitutionalism, and the sovereign will of the people are worth defending at all costs."-Governor George Natembeya
