@AnthonyMKreis If helpful. The customary intl law rules exist as a result of state practice/opinio juris, not from deduction from some unifying theory. Even if the recognized exceptions to territorial jdx could be explained by an allegiance theory, it doesn’t justify inventing new exceptions.

The exceptions Coke talks about are *exceptions* built for war and international affairs. They aren’t about anything ordinary and domestic, certainly they aren’t worth trying to infuse some new idea of allegiance into. And if you bother to trace the law after 1608, that’s clear.

The violence done to the common law, once again, verges on depraved indifference. Coke did not articulate the common law as it was described here. In fact, to suggest Coke issued an opinion on behalf of a court and as his own musings is ahistorical and wrong to say in print.
