The judge made an interesting point along the lines of "such-and-so other case was even worse than this, and the SJC allowed *that* to go forward". That suggested that he's at least *somewhat* attuned to the fact that this is a malicious prosecution. I think the fact of the matter is that in Massachusetts, the defendant's motion to dismiss exists only as a formality. It doesn't matter how badly the prosecution hornswoggled the grand jury.

I did not hear about this because I am not following this case but the idea that the clerk's office and the judge did not mute everyone is shocking to me. I presided over countless ZOOMs during and after COVID in Massachusetts with many people on the screen. Everyone was muted until I asked for them to speak. It's 2026! How do they not know this?
