A viral TikTok shows a truck that refuses to shift into drive because its internal cameras detected emotional distress in the driver's eyes. The scenario walked through in the segment makes the stakes immediate: a ranch emergency, a chainsaw accident, someone badly hurt, and a truck that will not move because the sensors read panic as impairment. Ford's telematics system already allows fleet vehicle cameras to be pulled up in real time and marketed directly to insurance companies. But who actually owns the data? Not the person whose name is on the title. This goes far beyond one truck brand. Subaru has been marketing eye-movement detection technology since 2021. Volvo put out a press release celebrating in-car cameras designed to detect intoxication and distraction, with the ability to intervene if the driver does not respond to warnings. And buried inside HR 3684, the Infrastructure Investment and Jobs Act, is a federal mandate requiring all passenger vehicles manufactured after the effective date to be equipped with technology that passively monitors drivers and prevents or limits vehicle operation if impairment is detected. The word "impaired" is not defined. Representative Thomas Massie went to the House floor to describe what this law actually says and asked a question nobody in the federal government has answered: once the car disables itself and leaves you and your children on the side of the road, how do you appeal that decision? The Ford patents go further still. One describes a biometric identification system that collects data from the driver, runs it against a security events database described in the patent itself as including missing persons, persons with warrants, persons with criminal history, and persons associated with security events. The patent then specifies that indications of a security event should be presented only to administrators, not to the participant. The participant is the person sitting in their own car, paying for their own fuel, unaware that their vehicle just ran their biometric profile against a law enforcement database and flagged something. The COVID parallel is there, too. During the pandemic, buildings were equipped with thermal sensors to detect fevers among people walking through lobbies. That leaves us asking: what happens when a car detects an elevated temperature or other biological signal during a declared health emergency? Does a self-driving vehicle have a protocol for that situation? Does consent factor in at all? The throughline connecting vaccine passports, digital health credentials, smart city surveillance infrastructure, and in-vehicle biometric monitoring is the same one: autonomous data collection, autonomous decision-making, and systems designed so the subject never knows it is happening.
