1/6 Yesterday, in a SkyECC trial before the Landgericht Darmstadt, a crucial fact was established. My colleague and fellow @IntercrimeDA member, Andreas Milch thoroughly questioned an IT forensics expert from the BKA. Outcome: the existence and use of Chat-X has now been officially confirmed.

5/6The questioning exposed fundamental flaws: neither the court nor the defence knows the analysis criteria or AI algorithms employed by Chat-X. This lack of transparency and verifiability undermines data integrity and violates core principles of a fair trial (Art. 6 ECHR).

8/8 Exciting (and important) times in Strasbourg. I’ve been warning for years that these cases would eventually reach this level – and now they have. Transparency over blind trust. Defence rights over convenience. The rule of law is pushing back. What are your thoughts on how this will affect pending cases in the Netherlands, Germany, France and beyond?

7/8 For defence lawyers working on EncroChat, SkyECC, ANOM and similar cases across Europe, this could be a clear signal. The legal grey zone that allowed thousands of convictions based on unverifiable hacked data is closing. The ECtHR might be drawing a line: fundamental rights to a fair trial and privacy cannot be sacrificed for investigative convenience – even in cross-border operations.
