@LessCrime …..the necessary, or honestly believed to be necessary, test is applied to the officer’s decision in the moment. The ‘absolutely’ bit is for the ECHR versus the government or the force.

This article is surprising because it suggests the head of the IOPC investigation into this police shooting doesn’t know the legal standard for self defence. He says “A police officer can only use lethal force when it’s absolutely necessary”, but that’s not the law, is it? …

@LessCrime @Geoff_Pearson Yes, a quick summary would I think be that ‘absolutely necessary’ is a Human Rights test, for the force to answer under a specific Article 2 challenge if it happened (a test of operational command)…

@Geoff_Pearson Yes, maybe that’s the source of the confusion. But that’s the sort of distinction I’d hope they have access to specialist advice on.
