A judge has ruled in favor of @Colt_Shelby in his lawsuit against Governor Sanders. Shelby sued the governor after she set a special election to fill Senate District 26, the seat left vacant by Senator Gary Stubblefield's passing, for next June. (1/2)

Whatever our attorney general’s opinion, the dates set for these special elections are unacceptable. The general rule for any governor, any party, any district, should be, “How quickly can we restore representation?” If the AG needs to weigh in, you probably did it wrong.

#ARPX 🚨 Arkansas Attorney General Tim Griffin’s office has filed a motion to dismiss the lawsuit challenging the timing of the Senate District 26 special election. The state argues Gov. Sanders acted within her legal authority in setting the June 6, 2026 date, calling claims of wrongdoing “unsupported.” The brief also cites sovereign immunity, saying courts can’t overrule the Governor’s discretion on election timing. McGruder’s district tried to shut down early voting locations where a majority of minority voters lived in West Memphis— potentially tipping the scales in 2 of the MOST COMPETITIVE State Representative races in Arkansas. West Memphis voters took it to the Supreme Court, won their case, and elected Rep. Jessie McGruder, an educator and public servant. NOW, Rep. Real Question: has anyone seen a cost breakdown on the disallowed foods versus their healthier alternatives? I’m less worried about policing health than I am the price of fruit loops for breakfast compared to bacon and eggs.

Today I was the first governor to submit a waiver to the Trump administration to end taxpayer-funded candy and soft drinks in food stamps. Taxpayers should not be subsidizing poor health on the front end and paying for it on the back end with skyrocketing healthcare costs and federal debt. Let’s Make America Healthy Again!

@TomMarsLaw The sponsor testified on the floor that it will avoid jurisdiction in the Pulaski County trial courts. (Despite the bill failing to repeal 16-60-104.) I can’t figure out for the life of me how the appellate courts can regulate standing.

@JenStanderfer Jen, now I get your point about “original jurisdiction.” I had read a news piece that made me think the Court of Appeals would have appellate jurisdiction to hear these cases. But original jurisdiction? That’s insane.

@TomMarsLaw Except how do you establish standing as a question of fact if you have original jurisdiction in the appellate court? The appellate courts send stuff back to the trial courts to establish standing. They don’t hear the evidence themselves. So who would they send it back to?

@JenStanderfer Jen, I read this Bill as being limited to appellate jurisdiction and not having any effect on the requirement that a party have “standing,” i.e., a sufficient connection to, and resulting harm from, the statute being challenged as facially unconstitutional. But I could be wrong.
