Also, the full meaning of your name, ‘AMUPITAN’, came to my understanding. So, I pray that as against your name, you will not be used to record evil history. You assumed office as chairman of the Independent National Electoral Commission at a time when public trust in institutions is fragile, and expectation’s of leadership very high. It is precisely for this reason that recent action attributed to the commission particularly the withdrawal of recognition of party leadership in the midst of a subsisting legal dispute, have generated deep concern and fears about the future of our democracy. It is particularly troubling that as far back as September 2, 2025 the leadership dispute within the ADC had already been formerly brought before a competent Court. Despite this, the commission proceeded on September 10 2025 to recognize the leadership of ADC led by David Mark. Having taken that position, with full awareness of a pending legal challenge the subsequent withdrawal of recognition, seven months after, on the basis of maintaining “status quo” races serious questions about consistency, timing, sincerity, and institutional judgment. Also, as a Professor of Law and a Senior Advocate, should it be difficult to understand that the Status quo was where the matter stood before they drag it to the court that made the pronouncement – appeal court in this case Are you not aware that by this action, you have brazenly given to Hon.Nafiu Bala the restraining order he is shopping for in court and for which the appeal court sent them back to the lower court? Now, what is left for the court to decide? In law timing is often as important as substance and in electoral governance perception is as consequential as procedure decisions that appear to intervene in internal party processes especially when judicial proceedings are ongoing, such action as this risk being interpreted not as neutrality but as alignment. This is not merely a legal question, It is a question of institutional responsibility. Nigeria today is under considerable economic and social strain in such a climate the role of the electoral umpire must be to stabilize not in flame. Eve Every action taken by the commission must strengthen public confidence that the playing field remains fair open and impartial. As a professor of law you understand that the authority of institutions rest not only on what is lawful, but on what is seen to be just, balanced, and measured. where doubt arises, restraint becomes a virtue of leadership. I do not have any doubt about the integrity of key officers at the Legal Directorate at INEC, I know, that they know the truth and would have advised you against this action that has brought everyone to disrepute in the eyes of right thinking citizens. This moment therefore calls for reflection not on legality alone but on legacy. Not on power but on trust. History will judge not only the decisions taken, but the spirit in which they were made, and whether they contributed to the strengthening or weakening of Nigeria’s democratic process. The expectation respectfully, is that the commission will act in ways to preserve its independence uphold fairness and inspired confidence across all side of the political divide. When great institutions err, they admit and correct. Let Hon. Bala Nafiu get his restraining order from the Courts and not from INEC.
