@MickeyMarch1 @JasonLavigneAB A Constitution isn't a contract. Mr Lavigne is right that the law isn't "settled" in that it hasn't been fleshed out. As a practical matter, if a large enough majority wants to leave, who's to stop them? I believe tha leaving would be foolish, but people have been fooled before.

The fact is, the Clarity Act is not tested law. The act has never been fully tested in the real-world context of a province voting Yes on secession. Until that happens, there will remain open questions about a) legality, b) process, and c) enforceability. The Supreme Court of Canada’s Secession Reference and the Clarity Act created a framework, but they did not produce a completed roadmap for every step that would follow a successful referendum. That test will only come when a province reaches the point of a Yes vote on a referendum question that the House of Commons accepts as clear. At that point, Canadians would learn how the process works in practice, not just in theory. The Clarity Act says the House of Commons must determine whether the question is clear and whether there has been a clear expression of will by a clear majority, but it does not define those terms with a fixed formula. Instead, it leaves those judgments to political institutions, taking into account factors such as the size of the majority and voter turnout. The Clarity Act has not clearly answered all of the major questions, including: 1) Which constitutional amending formula would ultimately be required. 2) What, in advance, would count as a clear majority. 3) What, in practice, would be accepted as a clear question. That is why it is fair to say the matter is not fully settled or tested in law. What the law does make clear is this: 1) A province can hold a referendum on secession. 2) Neither a province nor Canada can unilaterally force the issue under the Constitution; secession would require constitutional amendment and negotiations. 3) A clear Yes vote on a clear question would trigger a constitutional duty to negotiate in good faith towards secession. What is also true is this: 1) Newfoundland joined Canada after local referendums in 1948, followed by negotiations and legislative approval. Canadians outside Newfoundland did not vote in a national referendum on that decision. 2) Canada’s Constitution does not contain an express prohibition on secession in the way some constitutions do. Instead, the Supreme Court has said unilateral secession is not lawful under the Constitution, but a clear democratic expression in favour of secession would create an obligation to negotiate constitutional change. 3) International declarations of independence do exist as a historical path to sovereignty. Canada recognized Kosovo's declaration in 2008. Bottom line: people who say the process is fully settled law are overstating the case. The Clarity Act leaves major questions unanswered and would only be truly tested after a successful referendum. What is clear is that if Alberta, or another province, chooses secession, there is a lawful and democratic process to begin that path. What is not yet clear is exactly how every stage of that process would unfold.

So I did a thing... After losing my dearest soul dog to cancer a few weeks ago, I adopted a shelter dog. I was worried maybe it was too soon. I could never replace my baby Sy Girl. But I had all this dog love to give and no dog. Meet Faye. She's a year old and was rescued from a homeless camp, tied to a tree when she was just a young pup. She spent 4 months in jail - as part of a training program. She is calm and sweet. She reminds me of Sy in so many ways - though she's only half her size. Everyone, meet Miss Faye! Today is her gotcha day and a new start in life.

The Clarity Act was enshrined in 2000. The time to go to court to oppose a province's right to pursue independence through a refefendum was 26 years ago. They considered it a right when it was Quebec in question. Now that Alberta is considering it, things suddenly changed.
