FORMAL NOTICE OF BREACH OF CONTRACT AND DEMAND FOR IMMEDIATE REMEDY

Re: Improper Content Filtering and Breach of Premium Subscription Agreement
To Whom It May Concern:
This correspondence serves as formal notice that your company is in breach of the contractual obligations established under the Premium Subscription Agreement between X Corp (“Platform”) and the undersigned Premium subscriber operating under the username “PuttyDiveTeam” (“User”).
FACTUAL BACKGROUND
1.User has entered into a paid subscription agreement with Platform, specifically the Premium tier starting at $11.00 per month, which explicitly promises certain enhanced features including “Reply boost” functionality.
2.Despite maintaining this paid subscription, User’s legitimate comments and replies are being inappropriately and erroneously flagged as “Probable spam” and subsequently hidden from general view.
3.Concurrently, Platform is permitting actual spam content to proliferate, including cryptocurrency scams and fraudulent promotions that utilize hashtags and mentions related to Platform ownership, as evidenced by posts from accounts such as @DuffyDwayn2028 dated April 4, 2025.
4.This discriminatory filtering practice appears to be selectively enforced against User’s content based on viewpoint rather than any legitimate violation of Platform’s stated content policies.
CONTRACTUAL VIOLATIONS
This conduct constitutes multiple material breaches of our agreement, including but not limited to:
1.Failure to Deliver Paid Services: Platform has failed to provide the “Reply boost” feature explicitly promised in the Premium subscription package, for which consideration has been paid in full.
2.Bad Faith Performance: Platform’s selective enforcement of “spam” filtering against legitimate user content while permitting actual fraudulent content demonstrates bad faith performance of the subscription agreement.
3.Breach of Implied Covenant of Good Faith and Fair Dealing: By arbitrarily suppressing User’s non-violative content while collecting subscription fees for enhanced visibility features, Platform has breached the implied covenant of good faith and fair dealing inherent in all contractual relationships.
DEMAND FOR IMMEDIATE REMEDY
User hereby demands the following remedial actions be taken immediately:
1.Cessation of all improper filtering and spam labeling of User’s legitimate content within 48 hours of receipt of this notice;
2.Restoration of all Reply boost functionality as advertised and contractually promised;
3.Implementation of procedural safeguards to prevent future improper content filtering based on viewpoint rather than actual policy violations;
4.Written confirmation of these remedial actions and explanation of steps taken to prevent recurrence.
RESERVATION OF RIGHTS
Should Platform fail to remedy these contractual violations within the specified timeframe, User expressly reserves all rights to pursue appropriate legal remedies, including but not limited to:
1.Filing a complaint with appropriate consumer protection agencies regarding deceptive trade practices;
2.Pursuing claims for breach of contract, including actual damages, consequential damages, and specific performance;
3.Seeking class certification for similarly situated Premium subscribers experiencing identical discriminatory content filtering practices.
This letter is without prejudice to any other rights or remedies available under applicable law, all of which are expressly reserved.
Please direct your response to this matter to the undersigned at your earliest convenience, but no later than 48 hours from receipt.
