this is important. so read through this and hopefully you'll understand why i said this is impt... (this is long) first let's define what "estoppel" means...this word comes from an old legal term meaning to stop or prevent someone from asserting something. judicial estoppel specifically means: the court stops you from taking a position bcoz it's inconsistent with a position you successfully took before in court. now the perfect example here is the contract validity lawsuit filed by ador to all five members of newjeans. ador claimed numerous times in court that trust remained, that relationship could be restored and more importantly, that the contracts remain valid. bcoz of that very reason, judge hoe-il ruled in favor of ador. we all know what followed next. the maknaes were announced to be back ador. on november 20, reports surfaced that minji and danielle had already held individual meetings with ador, while hanni had not yet done so bcoz she was reportedly still in antarctica. (penguinsssssss) by late december, ador's public messaging shifts dramatically. suddenly the company is talking about hanni's return, minji's on-going negotiations and then danielle's contract termination. now that we're all caught up with the timeline, let's fast forward to the june 11 hearing and back to the topic of estoppel. danielle's legal team brought this up for a good reason. bcoz ador has been trying to argue that trust had been destroyed. like wrecked. torn. nuked. (rolls my eyes in utter disdain....) which is certainly an interesting position to take after spending months telling the court the contracts remained valid, the relationship could be restored, the members should come back, meeting with said members after they agreed to return, and then publicly talking about confirming their intentions to do exactly that. all that garbage. yes. ador garbage.... anyways, if trust was soooooo destroyed that danielle's contract needed to be terminated, then what exactly were all those meetings for? all the pr stunts about repairing relationships and crying in court. a waste of everybody's fucking time. so why is ador saying its broken? like twentyfivetwentyone never getting back together broken? they keep bringing up "new facts" but couldn't rly determine if "new" meant after the contract validity ruling or its just new information to them. they just don't want to confirm it...or are they afraid to confirm it? changing your reasons for suing someone might change, but the facts, the timelines, those can't be changed or mixed up. ador should stop trying to tell a story here and actually start acting like they have something on danielle or else let's just end this lawsuit and call it a day. oh and pay danielle billions of won for damages coz this shit is traumatizing. and that's why this estoppel argument is not a waste. its a very strong argument. one that is giving ador a very bad headache.
