I heard screaming and saw this Trader Joe customer assault the homeless man. Then the customer took his groceries and got in what appeared to be a ride share and left. Ballston, Virginia location.

Wrong. You cannot legally push someone who is “invading space.” I know personally. I was running in NW DC. Two men were walking side by side in front of me and took up the whole sidewalk. I had to run into the street to get around them. Suddenly I felt a yank on my back and then the men pushed me down to the ground. Lots of witnesses called police. The man claimed to police he was angry that I “invaded his space” when I got back onto the sidewalk. Well he was handcuffed, arrested, prosecuted and took a serious plea deal. Assault and battery is a crime.

I think I just bought this man a pack of oranges on Saturday outside the Ballston Trader Joe’s. He asked if I had any money to spare, and I told him I didn’t have cash but asked if he wanted something from the store instead. He said, “Vitamin C.”

@emilymiller If he is attempting to take his property or invade his personal space ordinary force (a simple push) in this case would be warranted. Any verbal exchange would be important as well. Just because one makes physical contact first doesn’t automatically mean they are the aggressor.

I’ve been the victim of battery twice. Men cannot just hit people on the street. In both cases, the men went to jail and the city pressed charges for both assault and battery. And yes I am armed.

@emilymiller @noonehereyet What happened to you? "Oh, drunk guy is harmless" has really worked out well… why didn't the guy just give him his groceries, amiright?!? The man was warned and still encroached. One could easily claim fear for life and/or property to warrant the 'shove' you call 'assault.'

1. DC citizens are armed (I am) 2. This is one mile away in Virginia 3. Homeless are not “all crazy and unpredictable”. 4. Many homeless here are veterans with mental illness and/or substance issues 5. Some homeless are schizophrenic and they are scary and best not to engage.
