Vamos rir um pouco: a Boitempo (@editoraboitempo), a maior editora marxista brasileira, lançou o livro "Fascismo e Liberalismo: Afinidades Seletivas", do Álvaro Bianchi - ele é o maior especialista em Antonio Gramsci no Brasil. O que Álvaro faz nesse livro, a julgar por suas opiniões no carrossel da Boitempo? Ele OUSOU questionar se o liberalismo/neoliberalismo têm algo a ver com o fascismo/neofascismo, e propôs uma conceituação mais crítica e inteligente: não associá-los diretamente, mas como círculos interseccionados cujas afinidades são parciais e contextuais. Não é uma opinião radical, porque é o óbvio que já foi compreendido pela academia italiana há mais de meio século... mas para a esquerda brasileira isso é um ultraje! A seção de comentários é engraçadíssima: só os esquerdiotas esperneando porque foram instados a pensar criticamente sobre o assunto ao invés de ficarem arrotando slogans e palavras de força como papagaios desmiolados. Against the advice of some people, I'm going to defend Chibi Reviews. The attack on lolicon content has nothing to do with protecting children. It’s a textbook case of “common wisdom” moral panic that will lead to a slippery slope of eroded privacy, mass censorship, and mass surveillance. First of all... Lolicon is not always sexual. In Japanese manga/anime, it is just an aesthetic preference for cute, petite, and youthful-looking characters, but many Western discourses flatten it into pedophilia. Actual sexual loli content is a minority/niche within the overall Japanese mainstream media. Criminalizing fictional content leads to an undue burden on law enforcement. It is the clearest case in the UK where REAL CSAM prosecutions fell by 60% according to a "Drawing the Line Watchlist 2025" survey... Meanwhile, prosecutions of fictional CSAM content is 40% of all image-related offences. This is occurring in the context where REAL CSAM is exploding online, with a massive increase in real children and young teens being victimized. Similar policies in Australia, the US, and Canada are causing real issues in distracting law enforcement from helping real victims. Another incentive for ignoring REAL CSAM is that it is enjoyed by too many ethnic minorities, such as the Pakistanis in the UK grooming scandal, and the authorities don't want to be seen as "racist" REAL victims of SA and abuse are massive... Over 650 million female and 410 million male victims are around the world, concentrated in locations such as MENA, and SEA countries, where laws are permissive for the exploitation of minors. Criminalization of fictional content distracts from this, as tens of millions of new victims are victimized systematically in the most vile manner imaginable. The widespread belief that lolicon is a “gateway drug” to real pedophilia and SV is treated as obvious "common wisdom", but the opposite is likely true. Japan is the global epicenter of legal lolicon content, with decades of permissive adult porn. Japan has one of the lowest reported per-capita rates of rape and penetrative child SA among developed nations... 2.2 cases per 100k in Japan vs over 20 cases per 100k in the USA.textbook The most vocal anti-lolicon crusaders are often later linked to real possession or distribution of REAL CSAM! This is the textbook definition of "reaction formation," a defensive mechanism in which someone overcompensates by aggressively opposing the material that causes their urges... also known as "projection." The worst part about it is that this creates a system of censorship, erosion of privacy, and destruction of free expression that doesn't stop at lolicon, but metastasizes to other issues, leading to authoritarian overreach. Then you get the usual suspects of mandatory age verification, algorithmic content scanning, platform risk assessments, and “prohibited idea” definitions that naturally expand to other speech, data collection, and expression. The “pedo” smear that's been weaponized by antis, anti-porn feminists, as well as religious conservatives, accelerates it. They label any resistance to banning content as “defending predators,” and the public tolerates more surveillance... because you don't want to be called a PEDO, do you??? It chills expression and speech not just on lolicon content but on the debate of real issues, like the UK grooming scandal, Japan’s low-rate evidence, or even criticism of the laws themselves. But just like being called a "racist" and "NAZI" is losing power... eventually the smear of "pedo" will as well, since like the former slurs, it's being applied too broadly in cases where it doesn't belong... and hopefully the criminalization of fiction ends while prosecution of ACTUAL predators improves. The real victims... the hundreds of millions in poor regions in MENA, SEA, and many other places, as well as the online grooming pipelines, are the ones getting screwed by this distraction.

No século XX, as ditaduras eram criações de partidos e grupos populares que tomavam conta do Executivo e subjugavam os outros poderes, transformando-os em meros balcões de chancela do regime. No caso do Brasil de Vargas, uma "ditadura da toga" foi instalada e, à época, era reconhecida por esse nome - mas foi criação do Executivo varguista para "constitucionalizar" o Estado Novo. O caso do atual Judiciário é radicalmente diferente. A sua existência institucional precede quaisquer dos atuais partidos e políticos populares, e acabou se tornando o principal vetor de poder porque a aceitação universal da "democracia" e a "constitucionalização" do sistema jurídico lhe concedeu poder de manejo interpretativo dos princípios do próprio sistema. Essas peculiaridades renderam ao Supremo o papel de intérprete dos princípios que moldam o processo legislativo e a validação da funcionalidade da democracia. Por causa disso, as decisões monocráticas, súmulas vinculantes e decisões colegiadas provindas do Supremo se tornaram o de facto lastro da legitimidade do sistema político, mesmo que contrariando outras regras constitucionais, infraconstitucionais ou a jurisprudência do próprio Supremo. É uma mistura curiosa de ditadura homeopática que se esgueira pelas brechas da interpretação constitucional, rendendo "relativo" tal ou qual direito fundamental quando for necessário, e confunde os atônitos espectadores através dos complexos meandros da administração pública: uma portaria interna transforma uma lei federal em letra morta; o direito fundamental da liberdade de expressão é relativizado numa decisão monocrática em sede cautelar; a jurisdição do Tribunal se estende sobre outras com fundamento num Inquérito sem prazo final etc. etc. O público e outros players do sistema político foram lentamente inseridos numa realidade kafkiana que mescla a legitimidade da democracia com atos autoritários proferidos num juridiquês incompreensível. Os representantes do povo que, supostamente, deveriam ser a vontade popular mais democrática possível que se encarna no Legislativo, são agrilhoados e precisam da chancela colegiada do Judiciário para saber se podem atuar de acordo com os regimentos internos de suas casas. Criticar os atos dos ministros se tornou, ipso facto, um atentado contra a democracia, porque, talvez na guinada patrimonialista mais extrema, sutil e sem cerimônias da história brasileira, tecnocratas judiciários conseguiram se transformar na palavra final daquela Vontade Geral aludida pelos philosophes, como Rousseau. Não é mais a celebrada democracia cuja aspiração moveu o constituinte de 1988, mas uma versão emasculada daquela democracia totalitária que Jacob Talmon exemplificou com os jacobinos sanguinários. Ao invés de cabeças rolando, contudo, há a prisão preventiva infundada, o lawfare que paralisa a vida da vítima e a passivo-agressiva “relativização” dos direitos fundamentais que, até ontem, podiam ser contados como uma conquista civilizacional contra o autoritarismo. Não mais. É a tirania entediante do juridiquês opaco, do autoritarismo constitucionalmente interpretado e da necessidade de fingir que tudo ainda é a conquista democrática que o final do século passado nos prometeu como remédio para os males que estamos atualmente enfrentando. Sinto que estamos só afundando lentamente nesse autoritarismo de laudas processuais e seções de julgamento, e "devidas vênias vossas excelências" etc. etc.
