理容や美容については、理容師法・美容師法で、理容所・美容所以外の場所で理容・美容をしてはならないこととされていますが、例外として特別な事情がある場合は理容師・美容師が利用者の自宅等を出張して施術を行うことが可能とされています。 特別な事情については、政令で、「疾病その他の理由により、理容所・美容所に来ることができない者に対して理容・美容を行う場合」などとされており、厚生労働省の通知で、「病気・障害・認知症・寝たきりなどの理由で来所困難な者」と「常時、介護や育児で来所困難な者」がこれに当たるとされていました。 特に働く方々にとって、理容室や美容室がお休みの日が勤務先の休暇と重なり、不便を感じておられる方が多いのではないかという問題意識があり、厚生労働省に改善を求めていました。 今般、厚生労働省において、地方自治体に調査を行い、その結果等も踏まえ、これまでに法令でお示ししていたものをより分かりやすくする観点から、以下の３つの場合について、通知が示されました。 ・常時対応が求められる等の業務や勤務環境で、理容所・美容所の営業時間中に外出する時間の確保が困難である場合 ・家族等の育児や介護に加え、時間的に拘束される業務を行っていて、外出する時間の確保が困難である場合 ・演劇、演芸、テレビに出演する者等に対して、その出演の直前に施術を行うことが必要と認められる場合 こうした場合にある方々は、出張理容・美容の対象となります。小さな一歩ですが、暮らしに身近な改革を進めていきます。
