4/ The U.S. Department of Labor has proposed a rule that could allow 401(k) retirement plans to include alternative assets, including cryptocurrencies. If finalized, the rule would provide a safe harbor under the Employee Retirement Income Security Act, with plan managers required to evaluate factors like performance, fees, liquidity, valuation, and complexity before including such assets. 3/ Kenya is moving closer to formally integrating virtual assets into its financial system, with a new Virtual Asset Service Providers (VASP) regulatory framework open for public consultation until April 10, 2026. It is expected to be finalized by the first or second quarter of 2026. The draft introduces dual oversight, with the Central Bank of Kenya regulating wallets, payments, and stablecoins, while the Capital Markets Authority oversees exchanges, brokers, tokenization platforms, and Initial Coin Offerings (ICOs). It also introduces stricter licensing requirements, including “fit and proper” tests, disclosure of fund sources, and requires details of operational and cybersecurity frameworks. Additionally, the proposal also sets high minimum capital requirements for stablecoin issues (KSh 500M), exchanges (KSh 150M), wallet providers (KSh 150M), and tokenization and ICO providers (KSh 200M). The tokens are issued on a 1:1 basis, with each token equal to one unit of either fund. This ensures they function just like traditional fund units while maintaining full regulatory alignment, legal parity, and strong operational standards.
