Each day we learn about Israeli airstrikes hitting schools, hospitals, apartment buildings, electrical facilities, and other critical civilian infrastructure in Gaza. How does the Israeli state argue these are legal? The same way the U.S. has increasingly done for years: It asserts these objects have “dual use” by both civilians and militants, however modest or poorly evidenced that claim of military use is. In this just published ​Article in the @YaleLJournal, @oonahathaway, @MaraRevkin, and I show how the rise of targeting alleged “dual-use objects” has undermined critical protections for civilians. Rather than mitigating civilian harm as intended, we show how the rise of dual-use targeting has created a porous category of targetable objects that are obviously critical to civilian life and yet are lawfully targetable—including traditionally protected objects such as private homes, schools, and hospitals. In essence, it has allowed states to dramatically expand the scope of legitimate targets to include almost anything, because in densely populated areas, much of the infrastructure and underpinnings of the economy critical to civilian thriving might be labeled dual-use. Dual-use targeting has been shaped heavily by the U.S. and its close ally Israel, with increasing use by states like Russia, Saudi Arabia and Iran. Its pernicious effects go beyond targeting; the “dual-use” justification has led to restrictions on essential items like pipes, water filters and pumps, spare parts of electrical generators, and even medical scissors — essentially thwarting efforts to meet the basic humanitarian needs of civilians. In this Article, ​w​e used ground reporting from Iraq and Syria and a rigorous study of U.S. military assessments to show the devastating effects this kind of targeting has had on civilians, by destroying medical facilities, water infrastructure, electrical grids, religious sites, oil infrastructure, agriculture, and so much more​ — while also compar​ing how at odds America’s own assessments of its impact were with the reality on the ground. As we show, the effects on civilians will be felt for generations, while also further eroding the principles of distinction and proportionality. Mamdani: So many of our victories were in neighborhoods that went for Donald Trump. We were told that we had now lost voters forever. And instead, what we found is that if you have a relentless focus on an economic agenda and you welcome people back, and you turn the political instinct from lecturing to listening, you can still have people come home to the democratic party, as long as you show them that's a party that will fight for working people, not those that are benefiting off the struggles of working people.
