New on EUTechReg: the Digital Omnibus won’t fix much unless Europe also reforms GDPR enforcement. My proposal: uncouple investigation from decision-making, and make privacy authorities prove their case before a broader expert tribunal—not just privacy insiders. Inspired in part by the specialised-courts model proposed by @lugaricano and @CompetitionProf in the Constitution of Innovation.

We propose a 7-question test for agencies and merging parties: What is the innovation goal? Which capabilities must be combined? Do the parties have them? What is the integration plan? Is implementation feasible? Are alternatives available? Could one firm achieve it alone?
