They can’t. Section 82 of the Penal Code states anything done by a child under ten years old is not an offence. It grants complete immunity. Juvenile Courts are for those between 10 to below 18, unless it involves a “grave crime” in which case that child may be tried as an adult.

I aspire to have this level of productivity in my life. This woman is insane.

Not that this is determinative, but there is already a parallel offence in the Penal Code (see section 298 Penal Code, charges in KK Mart case).

Question (out of curiosity) for the Shariah lawyers out there: Does JAKIM have jurisdiction over companies, especially if owned by non-Muslims? Also, if there is an applicable offence, is that still constitutional in light of Federal Court’s decision in Ikki Putra/Nik Elin?

From my readings, the standard of proof adopted in Shariah criminal proceedings is either Yaqin (higher) or Zan Al Ghalib (lower). For criminal cases in non-Shariah Courts, it’s beyond reasonable doubt. If offence cannot be proved to these standards the matter should be dropped.

I hope it’s borne in mind the legal test should be whether it could be the shoe logo, not whether it could be the word “Allah”. The answer to the former should be “yes”. Same applies to any police investigations into the matter.

* The defence of property, however, arguably only extends to offences committed or attempted by an assailant, not threatened.

* The assailant need not have completed the commission of the offence. An attempt or threat to commit the offence is sufficient to trigger the right to bodily self-defence (subject to the restrictions above) (section 102).
