QCCA noted lack of connection with federal or provincial Crown suggests that Commission would not be public body, but added that SCC's account of why Charter applies to Vuntut Gwitchin First Nation in Dickson could suggest that Commission is public body [22].

Because parties agreed Commission was private body, QCCA declined to decide whether it would be better characterized as public body and subject to judicial review on that basis [22-24].

Quebec law extends QCCS judicial review jurisdiction beyond the SCC's description in Highwood Congregation of judicial review being available only when state actor making decision of a public nature.

In Kahnawà:ke Gaming Commission v Magic Palace, 2026 QCCA 200, QCCA found decision by Commission established under Kahnawà:ke gaming law is subject to judicial review by QCCS, but only as decision by private body, not public one: canlii.org/en/qc/qcca/doc….
