According to the plaintiff, the conversation included discussions indicating that, following ComplexCon in Hong Kong, arrangements were underway for projects including the filming of a music video related to a collaboration with the American band Emotional Oranges, that a track was scheduled for release on May 16, 2025, and that an artist fee of $175,000 (approximately KRW 240 million) had already been paid. The plaintiff argued that "this makes it clear that they had no intention whatsoever of complying with the injunction ruling." After noting that Danielle's mother allegedly made remarks such as, "Let's backdate the contract signing date to before the injunction ruling," and "Let's have the payment made to Marsh Danielle's older sister's business," the plaintiff stated, "Even though the injunction ruling had already been issued, this clearly reveals their intent to continue violating the contract, with no intention whatsoever of complying with the injunction ordering them to honor the exclusive contract." The plaintiff continued, "ADOR only became aware of these matters at a later stage, and in light of the seriousness of those violations, concluded that it could no longer maintain its contractual relationship with Danielle's side, which is why it issued a notice of termination." It added, "Marsh Danielle's violations also involve the Omega contract and several other agreements, but we will not address those here." The plaintiff further stated, "The defendant's side has repeatedly argued that this lawsuit would effectively halt Danielle's entertainment activities, but Danielle is free to continue her activities. The plaintiff has absolutely no reason to interfere. We do not understand why this claim continues to be made." It added, "Based on Marsh Danielle's breach of the exclusive contract, we are seeking contractual penalties as well as damages for harm to ADOR's business reputation, among other claims." Regarding former CEO Min Hee-jin, the plaintiff alleged, "She violated her duty of loyalty and duty of care as an inside director of the plaintiff company and encouraged the repudiation of the exclusive contracts with ADOR." After presenting conversation records dated October 20, 2024, the plaintiff further claimed, "Min Hee-jin told the NewJeans members' parents that she would structure matters in a way that would allow them to avoid financial liabilities such as penalty payments or damages." The plaintiff added, "Until she stepped down as an inside director of ADOR, she remained subject to the duties of loyalty and care under Article 339 of the Commercial Act, and those duties were violated." As for Danielle's mother, the plaintiff described her as "the parent who played the largest role in assisting Min Hee-jin's unlawful conduct." The plaintiff stated, "Frankly, when looking at the process that led to the termination of these contracts, it is difficult to believe that the NewJeans members themselves independently made all of these decisions. Upon examining the details, however, it becomes clear that Min Hee-jin actively encouraged these actions. Between Min Hee-jin and the parents, and between Min Hee-jin and the members, Danielle's mother played a substantial role. For that reason, we are also seeking damages against her for aiding and abetting Min Hee-jin's conduct."
