You don't seem to understand international law. UNGA resolution 3314 explains that when a third country allows its territory to be used by another state to launch an attack, it crosses a legal line from "neutral bystander" to "accomplice." Under Res. 3314, this specific scenario is addressed directly as an act of aggression: "The action of a State in allowing its territory, which it has placed at the disposal of another State, to be used by that other State for perpetrating an act of aggression against a third State."
