Unresponsiveness is NOT the same thing as unconsciousness: people with a head injury may be aware, but unable to respond. A recent article in JAMA highlights this difficulty: “Covert consciousness, the enduring capacity for subjective experience even when all behavioral signs have ceased, challenges controlled (organ) donation. If a patient who appears insensate is in fact conscious despite being unable to move or communicate, the likelihood is increased that care decisions will rest on the mistaken presumption that the patienthas permanently lost consciousness or the potential to recover it…Growing recognition of covert consciousness raises a disquieting possibility: that individuals deemed critically ill and unconscious retain residual awareness during withdrawal of life-sustaining treatment and peri–organ donation procedures.” In 2019, Larry Black Jr. was made an organ donor and taken to the operating room just one week after his traumatic brain injury. His family said they consented to donate his organs because they felt pressured by the organ procurement team. “I heard my mama yelling,” he recalled. “Everybody was there yelling my name, crying, playing my favorite songs, sending prayers up.” “He said he had tried to show everyone in his hospital room that he heard them. He recalled knocking on the side of the bed, blinking his eyes, trying to show that he was fighting for his life.” But the family was told these were just reflexes.  Fortunately, his neurosurgeon heard the loudspeaker announcing Black’s “honor walk,” ran to the OR, and demanded Black be taken off of the operating table and returned to the ICU. Black recovered: he is now a musician and the father of three children. How many others like him never had this chance?

I completely agree with Lord Stevens, assisted suicide is not as medical treatment. Doctors have no business in being involved in this and the state should not coerce them to do this. As doctors we have a duty to prevent suicide. We have a duty to provide high quality palliative care and to treat depression. As for the argument that the proposed legislation is not a slippery slope. The scope of such legislation has expanded in many countries (Canada, Belgium, Spain, the Netherlands). We heard from Baroness Gerada yesterday, suggesting that every doctor must be trained in referring patients for assisted suicide. The slippery slope is ready and waiting.

Lord Stevens, former CEO of NHS England, says defining AS as a treatment would be incoherent, and could undermine conscience protections: “The professional duties on a doctor are potentially in play… It will give rise to questions of the obligations on a doctor to raise [AS].”

This is a key point. If assisting death is defined in law as “medical treatment“ all doctors and healthcare professionals will be obliged to participate in it- or face regulatory consequences. The GMC is already revising their guidance. Consultation is open until June.
