Palestine has no army. This means that every Palestinian, regardless of political or resistance affiliation, remains a civilian under International Humanitarian Law (Law of War) and is entitled to full protection. Why was the wanted war criminal and biggest child killer in history, Benjamin Netanyahu, aka f*cking Mileikowsky, wearing a Red Cross uniform while serving as a terrorist in the Sayeret Matkal death squad of the Zionist rapist terrorist IOF? Under IHL, armed resistance movements in colonized or occupied territories may lawfully wear civilian clothing where circumstances of hostilities make continuous distinction impossible, provided they carry their weapons openly during military engagements (API Art. 44(3), 48). By contrast, colonizing armies are absolutely prohibited from feigning civilian status; such perfidy constitutes a grave breach and a war crime (API Art. 37(1)(c)). Civilians retain their civilian status even when directly participating in hostilities, losing protection only for the duration of such participation (API Art. 51(3), 50(3)). ⚖️ This means: Resistance fighters in occupied Palestine are protected combatants even in civilian clothes, as long as arms are openly carried in engagements. The Zionist army dressing as civilians is illegal, perfidious, and a war crime. Palestinian civilians remain civilians under law, even if they resist. Under International Law, the occupying power has no authority to redefine or strip away the civilian status of the people it occupies. The Zionist entity’s attempt to brand the Palestinian people, their political movements, or their Resistance forces as “terrorists” is entirely unlawful and has no legal basis. 1. Civilian Status Additional Protocol I (1977), Article 50, defines a civilian as any person who does not belong to the armed forces of a party to the conflict. Because Palestine has no army, every Palestinian is by definition a civilian. Article 50(1) and (3) also make clear that in case of any doubt, that person must always be presumed to be a civilian. Article 51 reinforces this protection by stating that civilians enjoy protection “unless and for such time as they take a direct part in hostilities.” This does not mean they ever lose their civilian status, only that protection from being directly targeted is suspended during the brief moment of direct participation. The moment they stop, their full protection as civilians is restored. Their underlying legal identity as civilians never changes. 2. Lawfulness of Resistance Additional Protocol I, Article 1(4), explicitly recognizes that armed struggles by peoples against colonial domination, alien occupation, and racist regimes are to be treated as international armed conflicts. UNGA Resolutions 2625 (1970), 3236 (1974), and 37/43 (1982) reaffirm the legitimacy of the struggle of peoples for self-determination, including through armed struggle. These provisions directly protect Palestinian armed resistance and prohibit its criminalization as “terrorism.” 3. Jus Cogens and Erga Omnes The right of peoples to self-determination is a jus cogens norm, higher than any treaty, resolution, or domestic law. It is also an obligation erga omnes, owed to the entire international community. The ICJ has confirmed this principle since the Barcelona Traction case in 1970. To deny Palestinians their right of self-determination or to label their struggle as criminal is to violate obligations that bind all states universally. 4. No Legal Basis for Proscription Nowhere in the Geneva Conventions, the Genocide Convention, the UN Charter, or any binding treaty is there a right for an occupying power to proscribe political movements or armed resistance groups of the people it occupies. The law obliges the occupier to respect and protect the occupied population and to allow their political expression.
