Welcome to modern economics. @Google wins. @EU_Competition loses. Why? Because, thankfully, the Commission's remedy does not prevent Google from outbidding its rivals for Shopping box placement. Rivals have sought to overturn the remedy, but last week's ruling strengthens it!

🤔… Vestager today on the “remedy” in the Google Search (Comparison Shopping) case: “We are not stating the success of the remedy; we are stating how the remedy has worked so far…I have no point of view, because it needs some more thorough analysis on our side.”

@jcbcp @vestager At some point (soon), Commissioner @vestager is going to need to come to terms with the fact that in addition to being brazenly non-compliant in its own right, Google vehemently argued during the appeal that its CSS Auction offers rival CSSs nothing that wasn’t already available.

Just going through the detail of yesterday’s EU Court judgment against Google and so far (about half way) it doesn’t just reject Google’s arguments. It absolutely annihilates them. #GoogleShopping #antitrust

@lewis_crofts @Martinned81 Good point about MS not appealing their loss. But by that point MS were bruised & battered by the whole experience. Whereas Google have had (&, barring yesterday, are continuing to have) a whale of a time. So far, Google has thumbed its nose at equal treatment & got away with it.

@Martinned81 I reckon they will appeal. But someone still has to go to the top table and implore the board that Bronner is a hill worth dying on. And, lest we forget, Microsoft didn't appeal their GC loss. Nothing is certain.

I've slept on it. Here's a 'tepid-take' (HT @DrMJCole) on Google ruling. - politically: huge for @vestager - practically: won't change much becoz #DMA is new kid in town, - legally: EU judges' stance on 'essential facility' will cause controversy & perhaps an appeal /thread

Worth remembering: Google search case isn't about David vs. Goliath (sorry, @Foundem). It's about a decade-long corporate fight pitting Google against the likes of Microsoft, Naspers, Oracle, European publishers & other interests concerned about how they were losing lots of money

Plenty in the EU court judgment that could give @Google appetite for appeal. But that will likely be a political decision from the top, as much as a legal decision. Lots of rivals coming out saying EC should now go even harder against Google over shopping remedy & other markets
