The "public welfare" problem in the Unification Church dissolution. Patricia Duval: "Public welfare" and "social appropriateness" are not part of "public order" and cannot be legitimate grounds for restricting religious freedom. In Bitter Winter (April 23, Part 3 of 7), Duval argues the Tokyo High Court's March 4 dissolution of the Family Federation fails Article 18.3 of the ICCPR's "legitimate aim" test. The High Court held that civil torts harming "public welfare" violate the treaty's grounds: public order, safety, health, morals, or fundamental rights of others. Duval says the reasoning is false. Japan's "public welfare" and the ICCPR's "public order" are different concepts. Japanese civil law uses it for social acceptability. The ICCPR uses it for cases where the State must intervene for society to survive. Intimidation. Compulsion. Extortion. Exploiting the vulnerable. Japan has laws for all of it. Prosecutors have never used any of them against Unification Church fundraising. Not once, in forty years. Authorities never judged the conduct serious enough for State intervention. That alone places it outside Article 18.3. Soliciting donations is protected religious activity under the 1981 UN Declaration (36/55). UN Special Rapporteur Asma Jahangir (2005) held that "fundamental rights and freedoms" demands stronger protection than similar treaty language. Intervention is justified only in extreme cases like forced conversion. In fact, the forced conversion in Japan has been the abduction and forced de-conversion of Unification Church members. The UN Human Rights Committee ordered Japan to stop this in 2014 (CCPR/C/JPN/CO/6). The government had a duty to protect confined believers. It chose to dissolve their church instead. 徹夜祈禱会あかし：私は2年前、一般40日修練会に参加して多くの恩恵を受け、「信仰を頑張っていこう」と決意しました。しかし、日本に帰ってからは世の中に流され、かつての情熱を失い、信仰も次第に形だけとなっていきました。東京で一人暮らしをしながら管理栄養士として働く中、忙しさに追われて自分中心の生活になり、仕事での否定や失敗が重なる中で、ついに心が限界を迎えました。適応障害と診断され、休職することになったのです。 その後、教会の方の勧めで精誠を始め、120日目には孤独と不安を乗り越え、天の父母様の導きによって新しい職場環境へと繋がる恩恵をいただきました。しかし、それでもぶれやすい私は、「どんなことがあってもぶれない信仰の軸を立てたい」、そして**「お母様のために最大限の精誠を捧げたい」**という一心で、今回の霊性40日修練会への参加を決意しました。 自分を変えたいという思いで参加したものの、正直なところ「本当に天の父母様を感じられるのか」「真のお母様を本当の母として信じられるのか」という不安と疑いもありました。慣れない環境とハードなスケジュールで体調を崩し、開会式前は不満や将来への不安で心がいっぱいになっていました。 しかし、開会式の賛美の時間、私は必死に祈りました。 「何も思っていない不足な私で申し訳ありません。それでも、天の父母様、お母様と一つになりたいです。私はここにいます。どうか、信仰の軸を持たせてください」 そう祈りながら賛美していると、突然涙があふれ、体が熱くなりました。天の父母様が今、私の心に触れ、新しく生まれ変わらせてくださっていると感じ、固く閉じていた心が一気に解けていくような体験でした。 もともと歌うことが好きな私は、それから賛美の時間を心待ちにするようになりました。「賛美は祈りである」と学び、一つひとつの歌詞に心情を込めて歌いました。天の父母様とお母様が、どれほどの時間と苦労をかけて私一人を探し求めてこられたのかを思うと、自然と涙がこみ上げました。『父母様のもとへ帰ろう』を賛美したときには、家族や主体者、そして教会から離れている友人たちの顔が思い浮かびました。その人たちの事情を思いながら祈る中で、「自分にはできない」と思っていた伝道も、「この人たちのために何ができるだろう」という切実な思いへと変わっていきました。 二週目に入ると、「もっと懇切にならなければ」と自分にプレッシャーをかけ、かえって天の父母様と向き合えなくなりました。周囲と比べて焦り、感じられない自分に落ち込み、祈れない悔しさで涙を流しました。そんな折、訓練部長に相談すると、**「涙が出ることだけが懇切さではありません。それでも祈り続けることが大切です」**と言ってくださり、大きく救われました。それまで「どう感じるか」ばかりに囚われていた自分が、「どのような心で向き合うか」が大切なのだと気づかされたのです。天の父母様は、結果ではなく「求めようとするその姿」を喜んでくださっているのだと感じると、心の重荷がほどけていきました。 修練会中、日本にいる母から「父にガンの疑いがある」と連絡がありました。初めて「父を失うかもしれない」という現実に直面し、切実な思いで父のために祈るようになりました。祈る中で、父のこれまでの人生や苦労が思い起こされ、胸が締め付けられる思いで涙があふれました。「父もまた、天の父母様が愛しておられる大切な子女なのだ」と確信し、初めて自分以外の事情に寄り添う「他者のための祈り」を捧げることができたのです。 また、自分自身の堕落性に直面し、その幼さに落ち込むこともありました。しかし「ありのままの心を伝えてほしい」という天からのメッセージに触れ、幼子が親に話すように、自分の弱さも悩みもそのまま祈るようになりました。すると「それでも愛している。こんな私でも必要として、この場に呼んでくださったのだ」という天の父母様の深い心情を感じることができました。 今回の修練会を通して、私は**「求め続けること」「誰かのために祈ること」「自分から愛すること」**の大切さを学び、ここに来る前にはわからなかった「精誠の味」を知ることができました。これまでは聞き流していたみ言葉も、今では一言一句を逃したくないと、一生懸命メモを取る自分に変わっていました。私は、お母様の腹中で生まれ変わりました。 これから日本に帰り、家庭出発をします。夫婦生活の中でもこの心情を忘れず、天の父母様と共に歩み、主体者と支え合いながら愛あふれる家庭を築いていきます。そして、昨日よりも今日、今日よりも明日と、常に感謝の生活を送ってこられたお母様のように、万事を天の父母様が準備してくださった恩恵として受け止め、感謝を捧げる生活を送りたいと思います。

The Church could not have anticipated the shift. 【The Evidentiary Basis】 The 26 civil judgments underlying the dissolution relied on vague "social appropriateness" standards, addressed conduct from 30 to 40 years ago, and produced no new cases after the Church's 2009 compliance declaration. The court cited a "risk" of future recurrence as justification. Her conclusion: "The restriction on the right to freedom of religion imposed by the dissolution order cannot be considered to be prescribed by law within the meaning of Article 18.3 of the Covenant."
