To paraphrase @bendreyfuss, I'm just a dum dum but it seems to me Iran can outlast a blockade of the strait way longer than the US can. Nevertheless, to the extent Trump feels he needs to do something, better this than ending an entire civilization.

@ASFleischman Cue all the people who smugly quote US officials saying the opposite, as though anyone in the Trump administration has any credibility on this issue. Doesn't mean the Iran is telling the truth, obviously, but the appropriate default assumption is that Trump sycophants are lying.

While I think that Rodriguez probably forecloses the 14th amendment argument, I think that that in an ideal world private defense attorneys wouldn’t exist. Quality of counsel shouldn’t depend on your wealth

@ASFleischman Toward the end of an argument last year on probable cause in a search warrant, I butchered an analogy to the evidentiary vaue of finding a dismemberment manual in Stephen King's library. I stumbled over my point. But everyone got it, and people who watched it liked the analogy.

Maybe I say a name wrong, or a judge asks a multipart question and I answer only one part of the question, or someone interrupts me in the middle of a good answer. None of that shit matters. My job is to know the cases and the record and direct them to it.

To be honest after an oral argument I always feel like I pretty much nailed it. All you have to do is listen to the questions and try your best to give the judge the information they need. They're smart people. You don't have to say it perfectly to say it well.

@quirkyllama Nobody is stopping the federal government from deporting Abrego Garcia. He has agreed to be deported to Costa Rica. And Costa Rica had previously agreed. Trump wants him deported to Liberia just to punish him.

I don't want to defend RFK or MAGA conspiracists, but I'm genuinely surprised Matt doesn't get that there is a real complaint here. The core hypothesis of Trump II is "Trump doesn't control the govt" Call it the deep state, call it bureaucracy, or just call it the Judiciary. The battle over Abrego Garcia- a man who no one disputes is here illegally- yet the entire might of the Trump administration can't deport him! The whole thesis of Trump II is "Yes, the laws say X, but the bureaucracy + judiciary don't care what the laws says". Or the recent Federal Court ruling effectively preventing Berkeley from cleaning up tent cities. Does the GOP have a Federal Trifecta? Yes. Does a Blue City in a Blue State want to clean up homelessness? Yes. Did a Federal judge prevent them from doing so? Also Yes. If you want to understand what's going on in Trump 2 these points are central. Republicans do not effectively control gov't even when they have a trifecta. Between bureaucrats bureaucrats and the Liberal Judiciary, it's ~impossible to change policy even when the law is clearly on GOP side.

Here's my understanding. Correct me if I'm wrong. Iran set harsh terms. Israel has to leave Hezbolloh in place. Iran controls the strait, and can charge fees for its use. Both of these things violate international law.

If we go further, there's no telling the extent of our triumph. I'm merely thankful for the obvious success that's been achieved thus far. Anything else is gravy.
