Any case with a footnote that starts, "Curiously, the 'just and reasonable' rate requirement for oil pipelines is nowhere to be found in the current U.S. Code" is my kind of case. See, 105 F.4th 418 (D.C. Cir. 2024).

@LibraryBiker Good question. While it would have been messy because there are multiple amendments to the Act, I think the main reason is that the Bluebook abandoned citing to Acts in non-positive law titles years ago, which I think was a mistake.

@ShawnNevers Why not just cite the Act? Sheesh, we need to be teaching more Indian law (and citation) so maybe future judges will understand that to which they refer is not ancient history or deleted law!

Interesting case that shows one of the limits of current statutory compilation. Court wants to cite the Navajo-Hopi Settlement Act, which was in the US Code, but was removed in 2016 by OLRC during a reclassification. So, court cites the US Code as it existed in 2012...1/3

rather than the Act itself, because the Act has been amended several times. Of course, when you click on the link to the Code in WL, it takes you to the current US Code section which just says that the section has been omitted from the code. 2/3
