I keep seeing you post this, and as someone who actually followed the trial and understands how courts work, this is grasping at straws and misrepresents what actually happened in that trial.
This completely ignores the fact that the judge dismissed the second jury after the defense attorneys harassed jurors, and the judge wanted to avoid another mistrial (the judge after the second dismissal should have recused but I digress). The defense knows they lose if it’s a jury of peers. It ignores the fact the judge held the victim to a MUCH higher credibility standard than any of the defense witnesses (one of whom perjured himself). It also ignores the fact that the judge completely ignored written Canadian law that anyone under the influence cannot consent.
This case was not brought on by the victim. She settled (something something “innocent people don’t settle cases”). It was The Crown that went forth with criminal charges and felt they had sufficient evidence to convict them of a crime.
Also, within the Canadian court system, you cannot be “proven innocent”. You’re only acquitted/not guilty if the jury or judge feels there’s not sufficient enough evidence to go forth with convicting the perpetrator. Not to mention sexual assault cases very rarely ever result in convictions. The only reason this wasn’t appealed was because it would be really hard to overturn the flawed ruling (appeals courts typically favor the initial ruling).
The court system failed EM and basically gave a green light for this sort of thing to happen again with no consequences.
