This #SCOTUS opinion in Castro Huerta is horrifying and insulting to Indian people and tribes. I’m shaken. Every few paragraphs of the majority opinion has another line that dismissively and casually cuts apart tribal independence that Native ancestors gave their lives for.

Against hundreds of years of congressional action, against solid #SCOTUS precedent, and hundreds of years of history, the Supreme Court held today that states have jurisdiction over certain crimes in Indian Country by judicial fiat. A devastating result for our democracy.

As in Indian law, national power over foreign affairs/national security is “plenary”—that is, constitutional rights and judicial review give way to unbridled executive power. As I’ve written, this doctrine has roots in American colonialism and the dispossession of Natives. /1

#SCOTUS hears oral argument today in a case that attempts an end run around the Court's 2020 McGirt decision. Even more that a direct challenge, this case risks the legitimacy of the Court and our separation of powers--once again asking SCOTUS to operate as a super legislature.
