Hamilton County Prosecutor Connie Pillich has dismissed the murder case against Elwood Jones, nearly three decades after he was sentenced to death. Twenty-seven years on death row. A new trial granted in 2022. And now—no retrial at all—simply a dismissal for a convicted murderer. Let’s talk about what the public wasn’t told. When Judge Wende Cross ordered Jones released pending proceedings, she ordered EMU monitoring. Electronic monitoring. The kind that normally comes with an ankle monitor, compliance checks, accountability. Except in this case, while Jones was ordered onto EMU, he remained on the EMU list without an ankle bracelet ever being installed—per instructions to EMU from Judge Wende Cross. On paper—monitored. In reality—nothing attached. That wasn’t a clerical typo. That wasn’t a scheduling hiccup. That was an order that existed in name only, with no actual device ensuring compliance. Every time members of EMU attempted to remove Jones from the list—because they actually weren’t monitoring him, Judge Cross denied that request and insisted on leaving Jones on the monitoring list—but insisted that they do not actually attach the monitor to him…and yet, the court proceeded as if safeguards were in place. At the same courthouse, in plain view of Deputies screening people at security, Jones routinely arrived carrying a large bag filled with handmade teddy bears—“Elwood Bears,” as he called them. When questioned by Deputies, Jones openly stated the bears were gifts for Judge Cross, explaining that she loved her Elwood bears. A defendant—awaiting retrial for a capital murder conviction—bringing personal gifts into the courthouse for the presiding Judge. Read that again. Veteran broadcaster Lincoln Ware publicly praised Judge Cross for asserting her influence in granting Jones a new trial—casting it as a moral correction, a righteous intervention, a moment of Justice finally served for a Black man. Missing from that praise was any discussion of the fact that Elwood was a convicted murderer, or how his release conditions were not actually enforced—but made to appear as if they were in the Court’s documentation of EMU. Earlier this year, newly elected County Prosecutor Connie Pillich declined to pursue an appeal and has now ultimately dismissed the case outright. No retrial. No jury. No weighing of evidence in open court. Just a decision—made behind closed doors—that the State would walk away…and now Jones walks free. No ankle monitor secured… No public explanation for why EMU existed only on paper… No answers about the appropriateness of personal gifts flowing from defendant to the Judge…no explanation for why a capital murder case simply evaporated. Who was responsible for ensuring EMU compliance—and why wasn’t it enforced? Why were gifts allowed to pass from a defendant to a sitting Judge without disclosure or intervention? Why was this case dismissed rather than tested before a jury—after decades of insisting the conviction was sound? And would this level of discretion, indulgence, and silence have occurred in any other case? Justice is not vibes. It is procedure, transparency, and equal application of the rules. What matters is that the system did not do what it told the public it was doing—and that should alarm everyone. What about Justice for the murder victim—or their family? This is a disgusting abuse of power—as well as an ethical nightmare…but who will hold Cross and Pillich accountable?
