
I don't think that's a good judgement.
His friend died from running from police. Not from the joint felony they were engaged in.
This is potentially holding him responsible for a crime he had nothing to do with.
If he was peacefully arrested, I don't think he should be responsible for his friend running and getting killed by police.
That creates a paradigm where if you have co-conspirators, you can't go easy when caught.
