when a police officer truly believes that someone is trying to murder him by aiming a firearm at his head form 3 feet away and shooting (as Noonan apparently will testify), said officer doesn't issue warning shots or words of hope--he shoots center mass to neutralize the threat (even if it means killing the shooter) in furtherance of their goal of staying alive.

A well-trained officer with a gun pointed at him, which is fired at him, does not then negotiate with the armed threat by urging her to reconsider. He is trained to neutralize and end the threat. He is trained to shoot, center mass. And he would be legally justified to shoot and kill in those circumstances. Strange set of facts to support the prosecution theory. Of course, if the shooting officer believed KF was going to die after being shot, the prosecution theory would fully exonerate him in the inevitable investigation of his conduct.

All you animals willing to attack Justian Ayalian in defense of Kelsey Fitzsimmons are sick. As I said before, the "breaking and entering" story required a lot more context and stunk of a coordinated lie designed to deflect and attack. Here's some much-needed additional context: 1. Kelsey and Justin lived together until the day the RO was served. Justin was attempting to collect his belongings but then his crazy BM pulled a gun on a cop. He called for a police detail, brought people with him, and encountered Kelsey's father, who agreed he had a right to get his belongings and hugged him while expressing that Kelsey is "sick" and "needs help". 2. The bank account he was accused of illegally accessing and stealing from was a joint account. That's not stealing. 3. The $5,000 in that joint account came from a check from Justin's grandmother. 4. Justin requested and eventually recieved a police detail to get his stuff. Officers observed his belongings - hunting equipment, tools, male clothing, etc. in the home. 5. Kelsey's father was present for most of this "robbery". This bullshit really needs to stay off line. If Whiskey Tim Bradl is advising her to pull this bullshit, she should get a refund.

I’m fucking dead.’” - Attorney Marc Diller, 3/6/26 Well… that’s one way to end a week. After filing it, italicizing it in a motion so it would stand out to the Court, defending it in multiple pleadings and trying to explain it away once the audio started circulating publicly… Marc Diller walked into court today and admitted he got it wrong. The hearing itself started with a sidebar, where the attorneys spent quite a bit of time in a private conference with the judge. The attorneys then went into a room by themselves where they conferred with one another. When everyone came back on the record, Diller announced that the plaintiffs were withdrawing their TRO motion entirely. Instead, the parties agreed to work expeditiously and in good faith on a stipulation regarding the handling of Karen Read’s phones before they are returned to her custody. If they can’t come to an agreement on that protocol, the issue will go right back in front of the court. Importantly, the existing preservation order and prior agreements remain in place. Nothing about that changed. Another key point that came out of the hearing: anything related to the phones will now go through Read’s legal team first. Her attorneys will handle the review and extraction process, and while the plaintiffs can make suggestions about what they believe is relevant, the ultimate decisions remain with Read’s team. Which brings us back to the quote. Because let’s not forget how this whole thing started. The phrase “I’m dead. I’m fucking dead.” wasn’t buried somewhere in a filing. It was front and center, highlighted and emphasized as part of the argument for why the court should step in and block Karen Read from getting her property back. It was presented as if it were a direct, incriminating statement. And today, in open court, the attorney who put that quote into the record acknowledged that he misinterpreted it. 🗣 The motion built around that argument was fully withdrawn with Diller tucking his tail admitting that he was wrong. Sometimes the loudest accusations end with the quietest admissions.

In case anyone was wondering why I have to take my time and break down only one Diller filing a day.. it's because I have to interpret this type of shit. In layman's terms, Diller is saying: 🔹️I know I willingly did not follow proper procedure 🔹️This is all Karen Read's fault 🔹️I was forced to file a TRO because I was not brought into a criminal matter that has nothing to do with my civil case 🔹️The Court should allow me to not follow the rules and withhold Read from having her property back 🔹️I only filed the TRO as revenge and desparation for not being told about the criminal hearing 🔹️If the Court wants, they can tell me I need to follow proper procedure and I will file an affidavit 🤯🤯🤯🤯🤯🤯🤯

I’m being told that the recently released phone extraction is already being used to target and harass individuals who may have been sources, had information, shared opinions, or communicated with people on Karen Read’s side during the 2022–2023 timeframe. We’ve seen similar patterns before from that very side doing this harassing. When the sidebar transcripts revealed testimony about Jen McCabe allegedly threatening fellow witness Karina Kolokithas, selective messages quickly surfaced online attempting to discredit Karina. Something similar happened with Tom Beatty and his daughter Erin — the same Erin Beatty Colin Albert called at 12:33 a.m. on 1/29/22. Now we’re again seeing selective screenshots and carefully framed snippets circulating publicly - often without context - alongside the familiar dog whistles. What’s notable is that some of the same voices condemning “harassment” are the very ones who have publicly engaged in behavior such as drive-bys, license-plate searches, unsolicited phone calls or messages, and aggressive online targeting. We’ve also seen reports of property damage, complaints sent to employers aimed at getting people fired, and organized smear campaigns against individuals who speak out about certain witnesses. In at least one instance, one person was hired by a friend of a witness to conduct what was described as “private investigator” work on critics. If the concern is truly harassment, then the standard should apply to everyone. Again I point out the pure hypocrisy of this behavior. Let’s revisit this conversation when Michael Proctor’s phone extraction becomes public. Something tells me it may provide far more insight into the broader dynamics at play than the current fixation on Karen Read or David Yannetti communicating with Turtleboy.

@LawyerYouKnow I live in Utah and this case was on every news station for months. I’m quite surprised they picked a jury so quickly. Plus Kamas is not a very big town, I think she may have been convicted long before the trial started.
