McQuade’s three-word summary is precise. Color blindness is willful blindness. The Roberts court’s theory is that the Constitution cannot see race, and therefore any district drawn with racial data is presumptively unconstitutional. The theory treats historical discrimination as legally irrelevant - as if the specific communities formed by that history, shaped by it, disadvantaged by its persistent effects, are simply the product of government categorization that can be dissolved by declaring the categorization impermissible. Justice Thurgood Marshall warned in a dissent that the court’s practice of manipulating constitutional doctrine under the 14th and 15th Amendments makes it complicit in racial discrimination rather than its remedy. Frederick Douglass made the same argument in 1883 when the court nullified the Civil Rights Act of 1875. Alabama, Tennessee, Mississippi, and Louisiana are already planning special legislative sessions to apply Callais and erase majority-minority districts. The arc from 20 Black House members in 1985 to 43 by 1995 took a constitutional amendment, a unanimous Supreme Court ruling, and a decade of redistributing. The Roberts Court has created the legal tools to reverse that arc in a single election cycle. The amendments meant to secure representation are being used to eliminate it.

How do we know we're in late stage capitalism? One of my most popular articles ever included a long extract from a powerful closing speech by barrister Rajiv Menon during a Palestine Action trial in January. In the end, the jury refused to convict the six defendants. Menon is now on trial for that closing speech – for reminding the jury that they had a 350-year-old right in law to follow their conscience in reaching a verdict, even if it meant defying a direction from the judge to convict. Paradoxically, Menon joked in his speech that, because of that earlier legal principle, the judge, unlike his counterpart in 1670, could not lock them, the jurors, up were they to choose to follow their consciences. Instead, the judge is seeking to lock up the barrister. Does 2026 qualify as an improvement on 1670? It is believed that this is the first time a barrister has been tried for comments made to a jury in his closing speech. That should serve as a potent reminder of just us how authoritarian the current political moment is, and of how quickly long-established legal rights are being dismantled to protect British collusion in genocide. Here’s convicted American spy Jonathan Pollard detailing how Israel blackmailed the US during the 1973 Yom Kippur War by threatening to use nuclear weapons on Egypt if we didn’t bail their sorry asses out with a huge resupply of weapons. The day after this encounter Nixon ordered over $2.2 billion in arms to be sent to Israel, giving them a huge advantage over their opponents. Well that pissed the King of Saudi Arabia off to no end, so he did the only thing in his power to do: he cut off the oil to the US until we either stopped supplying Israel with weapons or we forced them to withdraw their troops from the land taken in the ‘67 war. The embargo lasted 6 months and the economic effects could be seen for years. And THAT friends is how America suffered its first oil shock bc of Israel.
