Not saying it's impossible Clemson is wrong about something here, but: The issue isn't a binding contract. The issue is once an athlete signs their scholarship they aren't in the portal anymore.
Contacting an athlete at another institution who isn't in the portal is tampering.

So Pete messaged a “committed” player that was only a Clemson student during the transfer portal but tried to make it sound worse.

Per Dabo Swinney, Clemson talked to Ole Miss GM Austin Thomas and made it clear that if Ole Miss didn't stop communicating with Ferrelli, Clemson was going to turn them in. Austin Thomas reportedly said he wanted no part of this but that "Pete Golding just 'does what he does.'"

See the issue is the direct contact by Pete after he was out of the portal. If an agent had done it, the school can claim ignorance and pay some money. Just so we are clear - per Clemson Tigers on Sports Illustrated -
“What Clemson did not have finalized, however, was a signed NIL or revenue-share agreement with Ferrelli, according to Tiger Illustrated. That absence isn't uncommon, as negotiations over contractual fine print can take time. The standout linebacker did, in fact, sign his scholarship papers, which officially removed him from the transfer portal. Had a revenue-sharing agreement been signed, Clemson would have been in a position to pursue damages directly from Ferrelli.”
He only signed financial aid papers.

The court of public opinion has no bearing on the NCAA investigation, and for that matter you don't give evidence away to people that don't matter. @HarryHayHopDad @bsrippee And even admitted in his own press conference that the agent wouldn’t give him the receipts. He should be able to produce the receipts of LF texting the Clemson staff to tell them what was going on, but mysteriously all THAT communication was oral.. yeah ok
