Can a governor declare an allowance tax-free if Nigeria Tax Act says the allowance is taxable? To the best of my tax knowledge, what can be done is bear the tax (ie pay the tax on their behalf). But a governor doesn't have power to rule an allowance as tax free. Matter of fact, the old Personal Income Tax and the new Nigeria Tax Act that governs taxation of employment income is a law made by the NASS. Even if a state can legislate on a matter, it has to be through State HOA passage, not a governor's fiat. Except the details here are incorrect, a governor cannot declare allowance or any income tax free.

Recent disclosures by the Honourable Minister of Health show that out of the ₦218 billion appropriated for healthcare capital expenditure, only about ₦36 million has been released. This is deeply troubling. At the same time, the Independent National Electoral Commission (INEC) has projected over ₦135 billion for legal expenditures. Let us reflect on this. The amount earmarked for election-related litigation is far higher than what has been made available for primary healthcare, the very foundation of a nation’s wellbeing. This is the same primary healthcare system expected to serve millions of Nigerians and support critical institutions such as: 1. University of Benin Teaching Hospital, Benin City 2.
