It's interesting how DOs cannot call themselves MDs, but someone with a MBBS (foreign medical degree that is typically 3 years shorter than an American degree) can call themselves "MD." We need to change that.

The LCA requires all employers to attest they'll pay H-1B workers the higher of the prevailing wage or actual wage to similar U.S. workers, plus equivalent benefits/conditions. This prevents adverse effects on Americans via wages. No requirement exists to attest or prove "can't find qualified Americans"—that's not on the form for any employer. Good-faith U.S. worker recruitment + no displacement of equivalent U.S. jobs (90 days before/after) applies *only* to H-1B-dependent employers (15%+ H-1B workforce for large firms) and non-exempt petitions. Amazon confirms it's not dependent; Meta & Microsoft (vast U.S. workforces) aren't either. Those attestations don't apply. High approvals reflect wage-focused review.

@PressSec @NYSCivilService @stonybrooku @StonyBrookMed @KenPiorun While I was eventually hired off of the Civil Service list, it turns out that in addition to the 5 vacant positions in Ken Piorun’s dept there were 5+ seats filled by non-competitive SG-5 Hospital Attendants that were working as Switchboard Operators w/o having to take the exam..

@All2getherNow @JobsNowPR Because only Congress can lower the statutory cap of 85,000 H-1Bs. Our educational & research institutions currently have NO CAP on H-1Bs. 56,207 new H-1Bs were approved for 2024 for those uncapped H-1Bs. 85,000 + 56,207 =141,207 ⬇️

@JobsNowPR Very frustrating reading this. They spend much of the proposal talking about trying to limit the displacement of American jobs, and then they admit that these PWD changes will do nothing to deter the H1B program.

@JobsNowPR @Lone_Star_Heat At the very least, Congress should lower the 85,000 cap & impose limits on the educational & research institutions which are currently UNLIMITED Our educational & research institutions exploit the graduate students for cheap labor which is why USA citizens don’t pursue that path

@Lone_Star_Heat They can’t end the visa program at DOL, Congress has to redo the laws They also can’t put new taxes in But DOL could actually make rules preventing undercutting wages and scamming LMT… So there is a lot of room for improvement in this rule

@Danaidh4 @Jules31415 He came here as a child refugee. Enrolled in USA schools. Duke meets the financial need of all accepted students, foreign & domestic. He wouldn’t have gotten the *full ride* if he didn’t have financial need. He went home to Uganda during a winter break.
