Yes, Stephen Miller could be appointed Attorney General without a law degree. The position requires only presidential nomination and Senate confirmation—no law degree, bar admission, or "learned in the law" qualification is mandated by current U.S. law (the 1789 reference was dropped in 1870). All 83 prior AGs happened to be lawyers, but it's not a legal barrier.
